Venezuela: Científicos recurren contra Ley de Ciencia, Tecnología e Innovación

Investigadores de varias universidades de Venezuela presentaron ante la Sala Constitucional del Tribunal Supremo de Justicia una solicitud de nulidad por inconstitucionalidad de la reforma de la Ley Orgánica de Ciencia, Tecnología e Innovación, con el argumento de que este instrumento "frena dramáticamente el desarrollo de la ciencia y tecnología en el país".

En un documento ­presentado por los científicos Marisol Aguilera y Klaus Jaffe, de la Universidad Simón Bolívar; Carenne Ludeña y Félix J. Tapia, de la Universidad Central de Venezuela; Carlo Caputo, del Instituto Venezolano de Investigaciones Científicas, y Benjamín Scharifker, de la Universidad Metropolitana­ se explica que entre los argumentos fundamentales para pedir la nulidad de la Ley de Ciencia y Tecnología están las disposiciones establecidas en los artículos 19 y 20 de la reforma que, de aplicarse, "podrían llegar incluso a suprimir la existencia de cualquier tipo de protección a la propiedad intelectual, con lo cual se frenaría aún más el proceso de innovación que la ley dice querer promocionar".

Señalan los recurrentes que en los citados artículos se observa que el derecho a la protección de la propiedad intelectual derivada de la creación científica y tecnológica quedaría seriamente afectado, pues se permite que sea la autoridad nacional la que establezca el régimen de propiedad intelectual sobre la creación científica y tecnológica que se desarrolle con recursos aprobados según el régimen establecido en esa ley o en normas generales en todo el país. En el instrumento legal no se señala cuáles son los límites de las restricciones que impondría la autoridad nacional en la definición del régimen de propiedad intelectual, por lo que los científicos advierten que podrían llegar incluso a eliminar la protección al derecho de tener autoría sobre las creaciones. Los científicos consideran que es urgente que el TSJ declare la nulidad de la reforma de la ley, porque se advierten consecuencias perjudiciales al avance de la ciencia y la tecnología en Venezuela. Ello también amerita que se otorguen de inmediato medidas cautelares mientras se define la situación, a fin de resguardar los derechos constitucionales de la comunidad científica y de las universidades, institutos y ONG que se desempeñan en las mismas áreas del saber.

Los científicos que cuestionan la reforma exigen que el instrumento legal sea modificado porque consideran que es contrario al texto constitucional, ya que restringe la actividad generadora de conocimiento al establecer el control financiero en manos del Estado, politizar la actividad científica al circunscribirla al ámbito ideológico del socialismo del siglo XXI, y no proteger efectivamente los derechos de propiedad intelectual sobre los desarrollos científicos y tecnológicos. Agregan que la entrega de recursos del sector privado al Estado, y no directamente al sector científico y académico, genera en la práctica un control absoluto de la investigación y desarrollo científicos, con la consecuente pérdida de autonomía de todas las instituciones científicas y académicas.

México: Firma de Convenio IMPI-COFEMER

Con la finalidad de representar, regular y promover los intereses del sector productivo en México y adoptar medidas que fomenten su desarrollo para lograr una mayor competitividad de la industria y del país, el 23 de agosto el Instituto Mexicano de la Propiedad Industrial (IMPI) y la Comisión Federal de la Mejora Regulatoria (COFEMER) firmaron un Convenio de Colaboración, en materia regulatoria, que permitirá coadyuvar en las labores de propiedad industrial con el objeto de fomentar la innovación y el crecimiento económico.  Mediante la firma de este Convenio se busca implementar acciones, mecanismos, bases y procedimientos de coordinación y colaboración entre el IMPI y la COFEMER con la finalidad de integrar, intercambiar y actualizar información que permita realizar diagnósticos y estudios para generar propuestas que faciliten las labores del IMPI relacionadas con la innovación y, en consecuencia, con el fomento de la productividad en el país. La firma de este Convenio estuvo encabezada por el Dr. José Rodrigo Roque Díaz, Director General del IMPI y por el Lic. Alfonso Carballo Pérez, Director General de la COFEMER.

Entre los objetivos planteados en el convenio está la identificación de áreas de oportunidad en el marco regulatorio de la propiedad industrial que permita facilitar las tareas del IMPI, lo que se traducirá en beneficios directos para los particulares y para la actividad económica en general. El acuerdo tiene una vigencia de tres años.

Cuarto Newsletter del INAPI de Chile


Se encuentra disponible para ser descargado el cuarto Boletín informativo del Instituto nacional de Propiedad Industrial de Chile Inapi, correspodiente a Julio de 2011.


El tema de portada de este cuarto número es la consulta abierta impulsada por INAPI para recibir propuestas de organismos públicos-privados y la ciudadanía, respecto a posibles modificaciones de la Ley de Propiedad Industrial, antecedentes que el instituto evaluará para presentar un proyecto de Ley al Ministerio de Economía. Actualmente ya hay un proyecto de reforma de la ley 19.039 ingresada a tramitación este mes, referida a la estandarización de procedimientos de marcas y patentes con relación a los tratados internacionales vigentes. La publicación también contiene un espacio donde se abordan algunos aspectos técnicos y jurídicos de las patentes de invención, notas de actualidad y una columna de opinión, esta vez a cargo de la subdirectora de marcas, Indicaciones Geográficas y Denominaciones de Origen Carolina Belmar, acerca de la importancia de consultar las bases de datos de marcas comerciales para la toma de decisiones.

e-marks: preparing for the Madrid Protocol?

Rio de Janeiro, during the XXXI Congress of the International Intellectual Property, organized by the Brazilian Intellectual Property Association (ABPI), INPI presented the new e-marks in version 2.0. The system should be available to the public in October.

This method is said to be much simpler for the user, contributing to a further increase in trade mark applications in 2011 – INPI mentions that it could reach a high record of 150,000 requests, an increase of 15% compared to 2010. One issue that I note is that INPI talks about the future: “the new system will pave the way to organize multiclass applications and co-ownership - requirements to serve on the Madrid Protocol.” Do you get it? Does it mean that they are really going to be a member and follow Colombia?

To cope with so many trade mark applications, INPI will use later this year the Intellectual Property System Automation System (IPAS) developed by the World Intellectual Property Organization(WIPO) to streamline its internal processing.

The Emerging Landscape of Indigenous Rights

The University of Buckingham, UK, will be holding a conference on 5 October. This is sponsored by the Centre for Multi-Cultural Studies in Law and the Family, and is a roundtable conference on Indigenous Issues.

OVERVIEW:
There are over 300 million Indigenous Peoples in the world today. They are found in every part of the world—from the Saami peoples in Lapland to Indigenous Peoples in Africa, Asia, Oceania, and North and South America. There has been an increasing focus on the international rights of Indigenous Peoples since the 2007 approval of the United Nations Declaration on the Rights of Indigenous Peoples. As the range of topics for this conference demonstrates, contemporary legal issues on Indigenous Peoples are both old and new. The relationship of Indigenous Peoples with the state, protection of Indigenous rights in expanding global economies, and respect for and the rights in Indigenous heritage are highlighted in the presentations at this conference.

A round-table discussion will follow the speakers’ presentations.

Protection of traditional knowledge - share and protect

Lima, will be the place to be if you want to discuss and analyze the protection of traditional knowledge of indigenous peoples. Representatives from 21 economies of the Asia-Pacific Cooperation (APEC) will meet on 1-2 September in the seminar "Successful Experiences in Implementing Tools for the Protection of Traditional Knowledge."

Peru will participate through Instituto Nacional de Defensa de la Competencia y de la Protecction de la Propiedad Intelectual (INDECOPI) explaining the experience that the institution has by promoting the registration of collective knowledge of indigenous people. They do for example prevent the granting of patent for inventions based on traditional knowledge and/or genetic resources. They do mention other types of protection out there such as: the classic systems of intellectual property, “sui generis" protection and preservation through organizations and government/institutions and public-private partnerships, databases and information systems, treaties and conventions.

Representatives will share their experiences from China, Thailand, Mexico, New Zealand, USA, South Korea, Vietnam, Malaysia and the Philippines. In addition, non-member economies of APEC will also participate such as Brazil, India and Panama, who have policies and systems with relevant protection.

Brazil: a celebration of taste

Brazilian Instituto Nacional da Propriedade Industrial (INPI) has received another application for a Geographical Indication (IG). On Tuesday, August 23, 2011, INPI received an application that corresponded to ‘biscoitos de São Tiago’, a traditional biscuits from the Region Campo das Vertentes in Minas Gerais. Producers chose the mode indication of source (Indicação de Procedência) which bears out the tradition of a product in a particular region.

The application was filed by the Associação São-Tiaguense, producers of the biscuit, which is formed by 23 members. The business generates around 700 direct jobs and its weekly production is approximately 150 tons. The city is the headquarters of the Festa do Café-com-Biscoit (Coffee and biscuit Party), which annually brings back tradition and attracts local tourists.

INPI makes the note that to prepare the request, the city was aided by the Center for Technological Innovation (NIT) from the Federal University of São João del Rei (UFSJ), which is INPI’s partner. Also this action is supported by the Foundation for Research and Support of Minas Gerais (FAPEMIG).

Surely they can celebrate the party with national products: a Cerrado Mineiro coffee (already a GI in the form of IS and pending a DO) and also some sweets: doces de Pelota served in Goiabeiras pots. If your taste is not that sweet, then try some shrimps: camarões da Costa Negra or some rice Litoral Norte Gaúcho or even better, a steak: Pampa Gaúcho da Campanha Meridional. However if you are not that hungry, then just walk around with a comfy pair of boots: Vale dos Sinos, enjoying a nice glass of wine: Vale dos Vinhedos and/or Pinto Bandeira – perhaps you like something stronger like Paraty. As the weather is sunny we recommend to wear a hat: Jalapão. Certainly we do not want you to be caught in the middle of any riots and see people throwing stones: Região Pedra Carijó-Paduana, Região Pedra Madeira-Paduana and, Região Pedra Cinza-Paduana; but is you are hit by one of them, don’t worry: treat yourself with some Manguezais de Alagoas.

Price mechanism or pipeline mechanism?

On 16 August 2011, the Brazilian Superior Court of Justice (STJ) held unanimously against the extension of the patent related to Actos(pioglitazone), a drug used to combat type 2 diabetes. This is another victory for the Instituto Nacional da Propriedade Industrial (INPI) against an international laboratory.

The laboratory was seeking to extend the patent from January 2005 to January 2011 using the mechanism established by Brazilian legislation called pipeline. Through the mechanism, the patent would have a year to be made to INPI and worth the time remaining in the country in which it was first filled without extensions. This is the understanding that the STJ has also held in other cases (check here and here).

This sentence holds special implications to the country where local manufacturers receive significant support from its government. A patent expiration would enable local manufacturers to produce and sell Actos at nearly half the price of the original drug.

Chile: Proyecto de ley estandariza tramitación de solicitudes de marcas y patentes

No sólo cuestiones relacionadas con el movimiento estudiantil tienen ocupado al Congreso chileno. El Jueves 11 de agosto fue ingresado en la Cámara de Diputados (cámara baja del sistema bicameral chileno que comprende también un Senado) el Proyecto de ley N°7862-03 de iniciativa del Ejecutivo, que tiene por objeto modificar la Ley N° 19.039 sobre propiedad industrial a fin de estandarizar y mejorar el proceso de solicitud de marcas y patentes. 
La modificación se basa en la necesidad de adecuar la legislación interna a los tratados internacionales suscritos por Chile en materia de Propiedad Industrial, tales como el Tratado de Cooperación en materia de Patentes (PCT) y el Tratado sobre el Derecho de Marcas (TLT).
En cuanto al PCT, según informa el Mensaje del Ejecutivo, a casi dos años de su entrada en vigor en Chile se han detectado algunos aspectos que pueden ser modificados en la ley nacional, a fin de lograr un mejor funcionamiento del sistema de presentación y recepción en la fase nacional de las solicitudes de patentes de invención y de modelos de utilidad. De ahí que sea necesario establecer reglas de rango legal que perfeccionen estos aspectos y otorguen el máximo de seguridad jurídica a los usuarios. Algunas modificaciones propuestas son: a) Incorporación expresa de normas generales y definición de términos del PCT en la legislación nacional: por ejemplo definir el concepto "Solicitud internacional", establecer al INAPI como  Oficina Receptora, establecer el español como idioma oficial de las solicitudes internacionales, etc,; b) Plazos de entrada en fase nacional y vigencia de derechos.
Con relación al TLT, establece sólo obligaciones de carácter formal pero no contempla un procedimiento alternativo de presentación de marcas comerciales, sino que señala un estándar que deberá ser observado por la oficina nacional de registro al momento de tramitar las solicitudes. Por ello, con relación al TLT, la reforma apunta a dos objetivos fundamentales:
a) Simplificar los procedimientos nacionales para el registro de marcas; y b) Establecer un marco regulatorio relacionado con cuestiones de procedimiento en las solicitudes de marcas, es decir, la estandarización de los requerimientos formales. 
No obstante no contener normas de carácter sustantivo, es posible apreciar ciertas disposiciones que podrían entrar en conflicto con normas de la Ley N° 19.039, por lo que se hace necesaria una adecuación de este último cuerpo legal. 
A la tramitación de este proyecto se le dio suma urgencia.

Brazil and the antidepressant market : changing the mood

The vice-president of the Superior Court of Justice (STJ), Minister Felix Fischer, restored the power of the National Health Surveillance Agency (Anvisa) to grant registration of generic medicines and the like, based on the active ingredient escitalopram (antidepressant).

Background
The judge of first instance had decided that ANVISA refrain from granting registration to a third party not authorized by Lundbeck Brazil Ltda - producer of Lexapro, the reference medical product – to use test results and data of the dossier sent by the company for the registration of the drug.

Also, the court held the invalidity of any drug registration already granted based on this dossier, in particular those obtained by companies Aché Pharmaceutical Laboratories S/A and Biosintética Pharmaceuticals Ltd, which are manufacturers of similar drugs. The judge applied the term of ten years to protect the rights of data exclusivity – in this case due to expire in September 2012.

Final decision
According to Minister Fischer, the decision of first instance has a “negative effect of erecting barriers to the participation of manufacturers interested in producing similar or generic drugs”. Therefore, the suspension of the sentence is advisable "in order to avoid the risk of weakening the national policy of generic drugs in the country". To that effect, the Vice-President of the Supreme Court re-establishes the power of ANVISA to register generic antidepressants with the said ingredient.

Note that the Brazilian drug market is governed by technical regulations and is regulated by a National Health Sanitary Surveillance Agency (ANVISA), which is a financially autonomous regulatory agency linked to the Brazilian Ministry of Health under management contract. No drug can be produced, imported, put for sale, or distributed in Brazil without registering with ANVISA.

Counterfeit Medicines – Enforcement and Intelligence

Last Friday, 19/08/2011, the National Health Surveillance Agency (Anvisa) published in the Official Gazette, the ban on the import and use in the country of Levitra 20 mg (a medicine used in the treatment of erectile dysfunction (impotence) ) lot BXB8551 because it is not genuine - counterfeit product. The fraud was discovered during a seizure of imported goods conducted by Anvisa’s team of ports and airports in Sao Paulo.

The real drug is manufactured by Bayer SA, which reported that the original batch was manufactured in 2002 – expiration date 2005.
The seizure is final and is effective immediately after publication of the measure in the Official Gazette.

México: Procedimiento Acelerado de Patentes

Desde marzo de 20011, el Instituto Mexicano de la Propiedad Industrial (IMPI) se ha integrado a la nueva tendencia internacional y ha puesto en marcha el Procedimiento Acelerado de Patentes (PPH - Patent Prosecution Highway) en conjunto con la Oficina de Patentes y Marcas de Estados Unidos (USPTO)

El mecanismo del PPH es una práctica que comienza a extenderse alrededor del mundo. En 2006 inició con la Oficina de Patentes y Marcas de Estados Unidos y la Oficina de Patentes de Japón; actualmente más de 12 oficinas de patentes, incluida la Oficina Europea de Patentes, han incorporado dicho programa.

Gracias al PPH las oficinas de patentes pueden acelerar el proceso de examen de patentes mediante el uso, en la medida de lo posible, de los resultados del examen de fondo obtenidos por las oficinas signatarias.

Entre las principales ventajas del programa del PPH, se destaca que:

a) Se reduce en gran medida el tiempo de realización del examen de fondo o novedad, ya que este examen disminuye de 27 meses, tiempo regular, a tan solo un periodo aproximado de 3 meses;

b) Se incrementa la probabilidad de obtención de la patente hasta en un 90%, sobre las mismas reivindicaciones ya aprobadas en la primera oficina; caso contrario al sistema tradicional en el que la probabilidad de concesión se reduce hasta el 50%.

El IMPI ha extendido su compromiso con la Oficina Española de Patentes y Marcas (IMPI-OEPM) y con la Oficina Japonesa de Patentes (IMPI-JPO).

Con estos acuerdos, las oficinas se podrán beneficiarse del trabajo realizado previamente por la otra oficina, lo que reduce la carga de trabajo de examen y mejora la calidad de las patentes. El examen expedito en cada oficina permitirá a los solicitantes obtener las patentes correspondientes más rápido y de manera más eficiente en cada país.

Google is an uncontrollable monster!

Brazil, 15 August, Google Brazil Internet Ltda. brought an appeal to the Brazilian Superior Court of Justice (STJ) for having been obliged by a lower court to remove offensive content placed in Orkut - a social network and discussion site operated by Google.

The party affected, a health specialist in Rio Grande do Sul, claimed the removal of all offensive messages and images. It is claimed that the doctor suffered a wave of attacks on the network and he tried to use an existing tool on the site to prevent the transmission of the defamatory messages. The tool, however, did not allow the exclusion of all messages against him. He asked also for compensation for moral and material damage.

Google however claimed that it would be impossible to scan the network for defamatory content against the party affected and thus, claimed that the doctor should have provided the email address of the attackers and indicate the measures to be censored.

The company also argued that if they proceed to remove the content, this would violate the freedom of expression. Moreover, it mentions that there is no legislation requiring Internet Service Providers (ISPs) to exert control of content placed on the Internet.

STJ
The Fourth Class of the Supreme Court did not consider the liability of the ISP. It only found that Google is obliged to delete the defamatory content of the pages struck against the victim, even without the provision of accurate email addresses from him.

The rapporteur, Luis Felipe Minister Solomon, considered that the lack of technical tools to correct problems does not exempt the company to seek solutions. "If Google has created an uncontrollable monster, it is only to be charged for any consequences generated by the lack of control users have of its social network," he said. Offensive messages could be captured by programming mechanisms or by a specialized staff, he added.

Yet, the responsibility is not automatic and does not occur at the time the message is posted on the network. The civil liability depends on the conduct, taking into consideration its responsibility and the damage experienced by others.

Litigio por marca Arroz Gandhi en Ecuador


En Ecuador (IEPI) está teniendo lugar un litigio por el registro de la marca “Arroz Gandhi”, que tiene enfrascados en una disputa a un abogado de la India (Lalit Bashin) y al solicitante del Ecuador Ana Doris Valverde Muñoz. Esta última ha solicitado el 26 de marzo de 2010 el registro para la clase 30 del clasificador de Niza de la marca "Arroz Gandhi" (solicitud 226973) para arroz, frente a lo cual se ha deducido el 15 de marzo de 2011 oposición por Bashin. El oponente  funda su demanda en que el tipo de producto (arroz en diversas variedades) puede generar riesgo de confusión en cuanto a su procedencia desde la India y, principalmente, porque registrar como marca la denominación "Arroz Gandhi", que en inglés se traduce como "Gandhi Rice", es casi una blasfemia en dicho país, pues podría herir los sentimientos del público en general que ha venerado y respetado a Mahatma Gandhi como el Padre de la Nación. También sostuvo en la petición que nadie se puede permitir comerciar con el nombre y la imagen de Gandhi pues es un líder de fama mundial. Agregó que la Ley India de Emblemas y Nombres (Prevención de uso indebido) de 1950 (The Emblems and names [Prevention of Improper Use] ACT, 1950) protege a "Gandhi", como un emblema nacional indio donde nadie puede usar el nombre o la representación pictórica de Mahatma Gandhi o Gandhi en una marca o un diseño sin la autorización del Gobierno de la India. El solicitante no respondió la oposición el 12 de julio y el 10 de octubre tendrá lugar el próximo estadio procesal. Este litigio viene a relacionarse con el art. 6 ter del Convenio de París, que ha sido objeto de entradas y comentarios anteriores a propósito de otras materias (marca país).

ONAPI y OMPI realizan programa de formación en República Dominicana

La Organización Mundial de la Propiedad Intelectual (OMPI) y la Oficina Nacional de la Propiedad Industrial de República Dominicana (ONAPI) iniciaron el "Programa de Formación para formadores en la Gestión Efectiva de los Activos de Propiedad Intelectual (PI) para las Pequeñas y Medianas Empresas" (Pymes) que comenzó el lunes 9 de agosto y culmina hoy en el auditorio del Centro de Exportación e Inversión de la República Dominicana (CE·IRD). 


La iniciativa tiene como objetivo contribuir con la formación de los recursos humanos de las Pymes en materia de gestión de activos de PI, para beneficio de los sectores interesados y de la producción nacional. La actividad se enmarca dentro del Plan de la Academia Nacional de la Propiedad Intelectual (ANPI), de manera preliminar para que al momento de la puesta en funcionamiento de la ANPI -cuya inauguración será el próximo 29 de agosto del presente año- República Dominicana cuente con un número importante de formadores tanto de la ONAPI como de la Oficina Nacional de Derecho de Autor (ONDA).


Juan José Báez, Director General de ONAPI, informó que "la OMPI a través de la Academia Mundial y la División de Pymes está confiando en nosotros, por lo que nos convertimos en el primer país de la región del Caribe y Centroamérica donde se implementa este programa dirigido única y exclusivamente para PYMES". Baez aseguró que esto es el resultado de ser los primeros en implementar las guías de la OMPI para este segmento de la producción nacional cuyo objetivo principal es básicamente el uso de las referidas guías.

El programa contempla talleres, mesas redondas y exponencias a cargo de profesionales nacionales e internacionales, expertos en materia de propiedad intelectual, entre los que se destacan los señores Marco Marzano de Marinis, Administrador de Programa, División de Pequeñas y Medianas Empresas de la OMPI, Gustavo Schotz, Director del Centro de la Propiedad Intelectual de la Universidad Austral de Buenos Aires, Argentina y la abogada Josefina Moreno Garcia, de México. De República Dominicana participan técnicos de la ONAPI entre ellos Ayalibis Garcia, Ivette Janet Vargas, Victor Ramirez, Carolina Morales, Carlos Medina, Raquel Núñez, Arlette de La Rosa, Lesli Franco, Josefina Aquino, Diana Cordero, Ramona de Aza, Narcis Tejada, entre otros

The Brazilian Instituto Nacional da Propiedad Industriale (INPI) has granted two geographical indications (GI) – published last Tuesday 9th of August.

The first one is camarões da Costa Negra (Black Coast shrimp) cultivated in artificial ponds in the towns of Acaraú, Itarema and Cross. The GI form sought by the Association of shrimp farmers of the Black Coast (ACCN) was as a Designation of Origin (DO) which will be the second for a national product. The product has features and qualities like high protein content and a sweet taste, due to the geographical environment of the region, including soil and water, and human factors involved in the cultivation technique.

The second is doces de Pelota (sweets of Pelotas), a municipality about 250 km from Porto Alegre, Rio Grande do Sul. The soil characteristic of the region encourages the planting of fruit trees such as peaches, quinces, among others, used for the production of jams and later for the manufacture of sweets.

From this date both Associations have a period of 60 days to pay the fee required and once comply with, INPI will issue the said certificate.

GI in Brazil
Brazil recognises Geographical Indication in two forms: Denomination of Origin (DO) and Indication of Source - DO is more valued because it depends on proof that the product has special characteristics due to geographical and human factors all together.

On August last year, (INPI) granted the first Denomination of Origin to a Brazilian product - granted to ‘Litoral Norte Gaúcho’ for rice.
There are 5 DO pending for other national products: Cerrado Mineiro for coffee and ‘Vale dos Vinhedos’ for wines which enjoy indication of source (IS) already. The other three DO applied for are for stones.

IPR Chapters in FTAs Costa Rica - China and Peru-Korea

On August 1st, two new Free Trade Agreements entered into force: Costa Rica-China and Peru-Korea.

Following the trend in recent bilateral agreements around the world, both FTAs include Chapters on Intellectual Property. While they do not include standards as high as those imposed by EU or US in their FTAs, it is interesting to see that they do contain some substantial provisions, in particular the one between Peru and Korea.
The FTA between Costa Rica and China includes specific provisions on generic resources, traditional knowledge and folklore and on geographical indications apart from general obligations to comply with TRIPS and Doha Declaration on Public Health, and on technical cooperation. There is a provision on border measures as well.
The FTA between Peru and Korea provides for similar obligations in these same fields, but it also include provisions on copyrights and related rights and extended provisions on enforcement.

These treaties are just another manifestation of the increasing relevance of trade relations between Asia-Pacific and Latin American countries. It would be interested to see the effects on the international protection of IPR of the regulation of trade relations among them. In this sense other important negotiations to follow are those of the Transpacific Partnership Agreement or TPP. Here is a good article on that in Spanish.

Chulucanas reconocida en Chile como primera Denominación de Origen extranjera

Hoy martes 2 de agosto de 2011 el Instituto Nacional de Propiedad Industrial de Chile (Inapi) dictó la resolución administrativa por la cual concede registro para la clase 21 del nomenclátor de Niza a la Denominación de Origen peruana "Chulucanas" solicitada bajo el número 801167 por la República de Perú el 27 de diciembre de 2007. El signo distintivo se aplica a cerámicas, que se caracterizan por la arcilla cuya zona de extracción es el distrito de Chulucanas de la provincia de Morropón departamento de Piura y las técnicas empleadas que son las rescatadas de las antiguas tradiciones culturales de la zona geográfica. El nombre geográfico corresponde a la zona de producción, extracción y elaboración de los productos. El distrito de Chulucanas limita por el norte con el distrito de Frías (provincia de Ayabaca), al sur con el distrito de Catacaos (provincia de Piura), al este con los distritos de la Matanza, Morropón y Santo Domingo, y por el oeste con los distritos de Castilla (provincia de Piura) y Tambogrande (Sullana).

Como primera denominación de origen extranjera otorgada bajo el nuevo sistema de registro chileno, creado en el año 2005, el Director Nacional del INAPI, Maximiliano Santa Cruz, entregará al Embajador de Perú una copia de la resolución que reconoce a “Chulucanas” en Chile.

La cerámicas originarias del distrito de Chulucanas son, desde el año 2005, utilizadas por el gobierno peruano para posicionar a Perú como “marca país” en los mercados internacionales.
