ARGENTINA: COMPUTO DEL PLAZO DE VIGENCIA DE LAS RENOVACIONES DE MARCAS


El pasado miércoles 21 de diciembre de 2011, el Instituto Nacional de Propiedad Industrial (INPI) de Argentina notificó la Disposición No. M-1795/11, por medio de la cual modificó la práctica relativa al cómputo del plazo de vigencia de las renovaciones.

A la fecha, los diez años de vigencia de la marca cuya renovación se solicita se calculaban a partir de la fecha de concesión de la renovación.

Con la expedición de la mencionada disposición, la vigencia de las solicitudes de renovación que se radiquen a partir del 1 de enero de 2012, se computará automáticamente desde el vencimiento del registro cuya renovación se solicite, independientemente del tiempo que demore el trámite de renovación.

Argentina: ISPs taken action - really?

In the midst of several court cases for copyright infringement, the video streaming site Cuevano has been made inaccessible by Internet Service providers.
Early this month we posted some news related to two different lawsuits brought against the site – one by HBO and the other one by Turner. In the latter case, the District Court Judge issued an interim injunction requiring the blocking of three particular series. In the same line, an Internet Service Provider decided to block the ‘complete’ access to the aforementioned webpage. Therefore, customer of the ISP named Telecentro could not enter for 12 hours the cuevana website. This measure was taken only by this particular ISP since subscribers from other ISPs could access cuevana webpage.[so, what abot the interim injunction? Why only one ISP took into account this matter?] Turner's response to the problems experienced by Telecenter’s subscribers was that Turner requested ISPs to block the TNT and iSat pay-TV channels – these two channels are the ones that contain the three particular series that the court granted interim injunction for. [once again, why only one ISP?]

On a statement Turner said:
The goal of this measure is to preserve the jobs that the company generates with such [tv] productions, with 800 professionals in the country and from their offices in Buenos Aires creates, produces and distributes 49 channels to more than 35 million households throughout Latin America.
Three weeks and a bit later we learn that another ISP has blocked access to cuevano.tv., this time Iplan. According to the newspaper the reason behind this was due to a court order. [I guess that this is the same one granted to Turner, why so far apart? can anyone enlighten me on this practical procedure, please?] I wonder if this interim measure is achieving anything at all.

Despite the international crisis, INPI sees an increase in numbers

During 2011, the Brazilian Instituto Nacional da Propriedade Industrial (INPI) report that there have been 30,617 applications for patents, against 28,052 requested in 2010. For trade marks there have been 143,435 requests (up to December the 20th) compared with 129,620 trade mark applications last year. According to INPI’s president, Mr Jorge Avila, number appears to show that despite the international crisis there has been awareness of Brazilian society about the importance of intellectual property

INPI’s aim is to promote the use of the intellectual property system as a tool of competitiveness, stimulating innovation in order to act effectively and to move forward the Brazilian technology and economy.

To further facilitate the access of the patent system, INPI is launching in 2012, the e-Patents, which will permit the filing of patent applications via Internet.

Shoes and Cheese -- stinky feet?

This week the Brazilian Instituto Nacional da Propiedad Industrial (INPI) announced the approval of two geographical indications: Queijo of Canastra (cheese) and calçados de Franca (footwear), both of them to be registered in the form Indication of Origin. The producers have, from now on, a period of 60 days to pay the fee required and once fulfilled, INPI will issue the said certificate.

Queijo of Canastra is a typical product from the region of Serra da Canastra, situated in Minas Gerais. It is handmade and is made out of raw milk. Produced for more than two hundred years, it is said to be related to the cheese called Serra da Estrela, Portugal, brought by immigrants. The climate, altitude, native pastures and waters of Canastra give this cheese a unique flavor: strong, medium spicy, dense and full bodied. Note that since May 2008 Queijo of Canastra became an intangible cultural heritage of Brazil, a title granted by the Institute for National Artistic and Historical Heritage (IPHAN).

Calçados de Franca...well in other words: shoes from the city of Franca. Franca is a large city in the Brazilian state of São Paulo and it is well recognised (at least by me) for its shoes industry. [OK, I need to be objective, they do also manufacture other things like furniture, vehicles, chemicals, pharmaceuticals, and according to a person that is sited next to me – men’s basketball, and Mogiana coffee -- but what can I say, a girl likes shoes!]. The city is also known for its leather production and you do not need to guess but if you put this together with shoes, then I am in! Full stop.

I am afraid INPI does not give any information regarding these two products, therefore we will need to wait for someone [perhaps a Brazilian reader? Or a lady?] who can enlighten us on what makes these shoes so special to grant them a GI.

Disclaimer: any resemble with the saying that there are shoes that make your feet smell like cheese should be avoided in this post.

Show me the money! Collecting royalties through associations

The Colombian Constitutional Court in a landmark case regarding copyright has held that artists in Colombia are not required to belong to an association in order to collect royalties.
The case refers to the called Fanny Mickey [mentioned last year in this blog], specifically Art 168, paragraph 2, last sentence which establishes the following “ This right of remuneration shall be paid through the collecting societies, formed and developed by performers of audiovisual works and recordings, according to the existing rules on copyright and related rights.”law

According to the decision "the performers of audiovisual works or recordings may exercise their right to payment using distinct collection mechanisms of the collecting society...” The situation is considered due to controversy around collecting societies such as Acinpro and Sayco. Thus, the sentence opens the door to artist to find another way to collect their royalties and so explaining that “limiting the collection of copyright to associations is a disproportionate restriction if one takes into account that there may be artists, performers, or producers who have the means to collect this in any other different way.”

Does the sentence follow the Constitution?
While Art 38 of the Colombia Constitution establishes the 'right of association' it does not establish the contrary. Yet, the Court says that the right to not be associated fits the constitution. According to the Constitutional Court as long as the artists can collect their remuneration rights using different mechanisms to the collecting society, including individual collection, it is appropriate.

Argentina: dot ar is live!

By Decree 189/2011, published on 13th December, 2011 the Argentinean government created the National Register of Domain Names on the Internet. The National Register will be under the competence of the Legal and Technical Secretariat of the Presidency of the Nation and will be headed by Gustavo Guillermo Justich.

The Register will be responsible for managing the top level domain Argentina ar. as well as the registration of Internet domain names of natural persons and legal entities. Added to this, the National Register will also be responsible for the resolution of disputes arising in respect of registration and ownership of Internet domains amid other objectives.

Nace primera IG de producto marino chileno:Langosta de Juan Fernández

El 5 mayo de 2011 se presentó ante el INAPI de Chile la primera solicitud para el registro de una Indicación Geográfica de un producto marino, para la clase 31 del nomeclátor. Siete meses después la solicitud ha sido aceptada con fecha 19 de diciembre, en un plazo de tramitación que se espera por los operadores del sistema de propiedad industrial sea un precedente para las solicitudes de esta clase de signos distintivos.

Esta concesión ha sido llevada a cabo dentro del contexto de ejecución de una política pública, gestionada en el Programa de Promoción y Protección del Producto Chileno, bajo la responsabilidad del Ministerio de Economía.

Con motivo de esta concesión de registro el actual Ministro de Economía de Chile Pablo Longueira, junto a la Subsecretaria de Turismo Jaqueline Plass y al director de INAPI, Maximiliano Santa Cruz, entregaron al Alcalde de Juan Fernández, Leopoldo González y los lugareños, una copia de la Resolución por la cual se reconoce la primera Indicación Geográfica para un producto marino chileno: la Langosta de Juan Fernández.

 El secretario de Estado expuso que “la propiedad industrial es una herramienta importante para el desarrollo de innovación y emprendimiento. Por eso este ministerio, a través del Instituto Nacional de Propiedad Industrial (INAPI), está fomentando las indicaciones geográficas, las denominaciones de origen, las marcas colectivas y de certificación, porque son signos distintivos que permiten que los productores puedan dar un nuevo valor agregado a sus productos, diferenciándose de sus competidores”.

El Director del INAPI sostuvo también que “los esfuerzos por utilizar esta herramienta deben ser realizados en conjunto con los sectores productivos; el Gobierno pone esta herramienta a su disposición y son los productores nacionales los que pueden y deben aprovecharla. Para ello, en los últimos meses nos hemos reunido con autoridades comunales interesadas en explorar posibilidades de protección de productos que poseen un reconocimiento en el consumidor nacional, con asociaciones de productores y con particulares interesados en crear y promover ciertas IGs/D.O., marcas colectivas o de certificación”.

La langosta de Juan Fernández pertenece a la especie jasus frontalis y ha sido reconocida como única en el mundo y sólo se encuentra en la zona geográfica correspondientes al archipiélago de Juan Fernández (islas Robinson Crusoe, Alejandro Selkirk y Santa Clara) y a las Islas Desventuradas.

Brasil: Johnnie against João

La multinacional Diageo, propietaria de la marca de whisky escocés "Johnnie Walker" impetró una solicitud de nulidad del registro de la marca brasilera de cachaza "João Andante" ante el INPI brasilero. El signo distintivo mixto "João  Andante" está registrado para la clase 33 del nomenclátor de Niza (9ª Edición) desde el 10 de agosto de 2010 a nombre de Joel Lana Celestino. 

La cachaza o cachaça (aguardiente de caña de azúcar con que se hace la caipirinha) es el destilado más popular de Brasil. En el caso de "João Andante" es elaborado de forma casi artesanal en un alambique de la ciudad de Belo Horizonte (Minas Gerais). La empresa tiene tres años de antigüedad y muestra un volumen de ventas de cerca de 200 botellas por mes, según dijeron responsables de ella a medios locales. Ambas marcas de destilados comparten de logotipo la figura de un hombre caminando estampado en la etiqueta, aunque con estilos muy diferentes. La botella de cachaza retrata a un caminante de aspecto harapiento, barba desaliñada, con una bolsa al hombro, un sombrero de campesino y una espiga en la boca, mientras que el logotipo del whisky escocés muestra a un hombre elegante, de aire aristocrático, vestido con sombrero de copa, levita, botas finas y bastón. João Andante se vende en la web de su fabricante por 40 reales (unos 21 dólares), precio medio para una cachaza artesanal que supera el valor de las marcas de cachazas industrializadas más populares. En comparación, una botella de Red Label, la versión más popular de Johnnie Walker, cuesta cerca del doble en los supermercados brasileños.

El caso es que el 24 de mayo de 2011 Diageo demandó la nulidad del registro de la empresa brasilera. El INPI confirió traslado y solicitó aporte de la documentación pertinente a los titulares de João Andante para que conforme el procedimiento establecido (art. 170  y ss. Ley de Propiedad Industrial de Brasil) una comisión técnica analice la posibilidad de anular el registro de la marca de cachaza, si se acepta que hay mérito para ello. El demandante de nulidad tiene también la opción de presentar su pretensión ante la justicia ordinaria de manera independiente a la acción en el INPI.

Política y derecho de marcas en Ecuador

En Ecuador está teniendo lugar un interesante asunto relacionado con signos distintivos y política. El gobierno ecuatoriano ha solicitado ante el IEPI  el registro como marca de las expresiones "30S", "30-S" y "Prohibido olvidar". Estas palabras están relacionadas con sucesos político-policiales respecto de los cuales Eduardo Arcos (bloguero de Ecuador) sugirió que se utilizara #30S en la red social Twitter. Su propuesta de denominación de los sucesos se basó en la confusión al comunicar la información referente a lo que estaba pasando al momento de los hechos, y tanto la ciudadanía como el Gobierno de ese país la adoptaron como el término de uso común. En su opinión el registro de la marca por parte del Gobierno sienta un precedente peligroso,"en el que si se hace una opinión o se crea un movimiento usando esas siglas, haya más peso legal para ir en contra de ello". Puntualizó que no ha presentado oposición al IEPI, pues "estar fuera del país complica bastante el proceso. He intentado por varias vías iniciar el proceso y estoy en contacto con abogados intentando decidir el mejor curso de acción", concluyó.

La oposición al registro fue presentada por el legislador Andrés Páez, quien sostiene que la autoría y propiedad intelectual de la expresión "Prohibido olvidar" corresponde al cantautor panameño Rubén Blades y que por lo tanto es de propiedad ajena, que no puede ser objeto de apropiación por parte del Gobierno ya que violaría el art. 5 de la Ley de Propiedad Intelectual ecuatoriana.

En cuanto a "30S", Páez sostiene que "la petición es insólita puesto que equivale a que en España se pretenda registrar la denominación "11M", que alude a la masacre terrorista del 11 de marzo de 2004; o que en los EEUU registren "9-11" en relación a los atentados del 11 de septiembre de 2001".

En la red, desde el martes recién pasado circula una petición para evitar el registro como marca de la expresión "30S". A través de la plataforma actuable.com, se pide a los usuarios que suscriban una carta dirigida al presidente del Instituto Ecuatoriano de Propiedad Intelectual, Andrés Ycaza, en la que solicitan que se niegue el registro tramitado por la Presidencia. La acción promovida por Ecuador30S, un grupo que actualmente desarrolla un documental sobre el papel de las redes sociales el 30 de septiembre de 2010, pretende recoger al menos 1000 firmas.

Brazilian music and the remastering of vinyl disc

EMI Music, the renowned music industry, will have to compensate Joao Gilberto, a Bossanova icon due to remastering (electronic process whereby there is an improvement of sound to a previously existing recording) discs without permission.

The singer-songwriter Joao Gilberto, was granted compensation for infringement of his moral rights. The case regards the CD titled 'The Myth', released by EMI without the permission of musician. The Brazilian Superior Court of Justice (STJ), Third Class by a majority vote, based the case on forensic evidence, recognizing that the three original songs recorded on vinyl discs suffered substantial modification after being remastered. This was a report from an expert who served in the process, and who found that, because of the remastering, "the work lost transparency in the middle frequencies and the acute sounds become very evident”.

One of the Minister that heard the case noted that when the works were reproduced on the CD, there was no existing contract between the author and the record company, and there was no authorization for using the works. He also added that the author's moral rights were compared to the right of paternity creating a link and an unbreakable bond between the work and the creator.

Background
The case was heard as an appeal brought by Mr Joao against EMI Music Ltd and the store Gramophone Records, Video and Computer Ltda. However, the Trial Court dismissed the action as unfounded in relation to the Gramophone because it was a mere trader. Initially, the court recognized the changes in the work, but not the damage as a result of it. In this regards the defendant alleged that the damage would not have occurred because the CD "The Myth" has received international awards, proving its quality. The court therefore granted Mr Joan only the right for property damage – receiving 18% royalties on sales of these CDs. The Court also granted Mr Joan payment of the amounts received by the label by using the work of Joao Gilberto in advertising campaign without his permission. The parties appealed to the Tribunal de Justiça do Rio de Janeiro (TJRJ) which dismissed the appeal and upheld the sentence of the first instance court. The claimant appealed to the Supreme Court where the Court not only recognised damages for copyright infringement but also the damage to his moral rights.

Abstract of project for a paper on a topic in the field of trademark or unfair competition law is now open. Abstracts should be approx 300 words and the deadline for submission is January 15, 2012. Leicester De Montfort Law School is hosting the Socio-Legal Studies Association 2012 conference. Abstract submissions for various streams/themes are welcome- Indigenous rights is there! So, any paper regarding traditional knowledge, healing plants and the like are welcome. Conflicto de marcas por cerveza Andes

"Andes" no es sólo el nombre del cordón montañoso que divide Chile y Argentina. También es el signo distintivo de dos cervezas, una de origen chileno y otra argentina.

La cuestión es que la filial chilena del grupo belga Anheuser- Bush Inbev (ABInBev) se prepara para lanzar en Chile su marca de cerveza de origen argentino "Andes" (hoy de la empresa belga con filial chilena), que nació en Mendoza hace 90 años y que es líder en la región de Cuyo. La matriz es además dueña de las marcas Budweiser, Stella Artois, Beck's, Bud Light, Skol, Becker, Brahma, y Quilmes entre muchas otras. 

El problema es que el lanzamiento al mercado podría chocar con una intimación para el cese del uso de la marca (Cease and Desist Letter) que ha impetrado el grupo CCU, principal compañía cervecera de Chile. Esta empresa tiene registrada la marca Andes para Chile  bajo el número 683275 desde el año 2004 para la clase 32 del nomenclátor , aunque actualmente no la explota en dicho mercado. Si bien la disputa todavía no llega aún a los tribunales chilenos, el diario El Mercurio informó que CCU ya le envío una carta a Cervecería Chile -la filial local de ABInBev-, en la que se reserva el derecho de ejercer las acciones legales pertinentes si se avanza con el lanzamiento.

En el diario La Nación de Argentina se consignó que: "[L]os especialistas en registros de marcas consultados [...] destacaron que el tema tiene varias aristas legales que trascienden largamente el mercado cervecero.'Un punto clave para la legislación de la Argentina y Chile, que son casi idénticas en materia de derechos marcarios, es el uso efectivo de la marca. La ley establece que cuando alguien registra una marca es para obtener un beneficio y, por lo tanto, tiene que darle un uso', señaló el abogado Hugo Cuervo, del estudio Rava".

En puridad, el sistema marcario chileno, a diferencia de otros en el derecho comparado (como el sistema europeo), no establece la carga (u obligación para algunos) de uso del signo distintivo en el territorio respectivo, ni consecuentemente, existe la figura sancionatoria de la caducidad por falta de uso, por lo que los registros constituyen propiedad dominical de sus titulares con la única carga del pago de tasas de renovación para su conservación, salvo, claro está, que se impugne su validez por afectar marcas notorias previas (mundialmente famosas). Así, vigente el registro, el derecho de exclusiva, y su jus prohibendi conservan sus propiedades excluyentes aplicables bajo los principios normativos de territorialidad y especialidad. En todo caso, para un mejor análisis empírico es recomendable hacerlo junto con una buena cerveza.

Argentina on illegal streaming

Cuevana.tv, the popular Argentine site (12 million monthly users)and also one of Latin America's most popular online video streaming site that offers movies, series and audiovisual content, continues to accumulate reasons to shut it down - favouring free distribution of copyrighted video without owners consent (copyright infringement). Yet, the first actual lawsuit against the site was filed on later November by HBO. Previous attend saw the free-to-air TV channel Telefe (Telefónica Group) threatening ‘Cuevana’ to bring a lawsuit but never materialised.

In a district court in Argentina, HBO formally accused ‘Cuevana’ of infringing the country's Intellectual Property Law (11.723). The lawsuit was filed against both Tomás Escobar (the young Argentine creator) and "Cuevana.com" [the news' reporter spotted the following error: the web page cuevana.com does not exist and explained that perhaps the lawyers surely meant cuevana.tv – Oh dear! – suing the wrong party, I am sure everyone has an anecdote on this]. The case was submitted before the Instruction Jury No.36, Secretary 123, and State Attorney's office Nº4.

But this is not all, it appears that cuevana.tv had ceased to exist – although momentarily. This was due to an injunction from a separate lawsuit filed by Turner Argentina. The District Court Judge Gustavo Caramelo Díaz issued an interim injunction ordering the Secretary of Communications and the National Communications Commission to block "access by any Internet user to the resources of the website known as Cuevana"[no .com or .tv added – safe players I will say]. Turner Argentina ( a production company) had complained about the unauthorised distribution by Cuevana of three TV series: ‘Falling Skies’, ‘BRIC’ and ‘26 personas para salvar al mundo’. The programmes are shown on the TNT and iSat pay-TV channels, both owned by Turner. While the injunction only required the blocking of these particular series, it has been reported that for over two hours the entire ‘Cuevana’ site remained inaccessible but later on, slowly beginning to resume normal services.

Will now Telefe be encourage to bring a lawsuit? Moreover, will it be this matter the last straw for Cuevana to shut down?

Brazil: new numbers for patents, industrial design and geographical indications’ applications

The Patent Board (DIRPA) and the Department of Contracts, Records and Geographical Indications (DICIG) reported last week that they are going to adopt a new code for numbering of applications for patents (for inventions and utility models), industrial design and geographical indication. The new numbering code meets suggested international standards.

The new standard will be accompanied by a breakthrough also in the procedures, since the numbering of the applications will be awarded at the presentation of it. This change will allow a more effective use - a more rapid step to the formal examination of patents (inventions and utility models), industrial designs and geographical indications.

Thus, as of January 2, 2012, applications for patents (for inventions and utility models), industrial design and geographical indication shall be numbered, according to the following pattern:

BR ZZ XXXX YYYYYY K

BR (Brazil) = Country code

ZZ = nature of protection

XXXX = year of entry into the INPI

YYYYYY = numbering corresponds to the order of application filed

K = numbering of the request - checked digit
The digits corresponding to the nature of protection will refer to: invention or utility patent; industrial design ; and geographical indication.

INPI observed that applications and patents filed up to December 31, 2011 will not be renumbered.

Counterfeits: not just CDs and DVDs

This month the National Council to Combat Piracy and Crimes against Intellectual Property (CNCP) has reported that the last past 6 years, the value of seizures of counterfeit and smuggled products has tripled.

In 2011, the government's projection is that the values of the seizures will hit record R$ 1.7 billion, about 30% more than in 2010. The items that have been seized the most during the year are CDs, DVDs, cigarettes, sunglasses, watches, shoes and handbags. The government estimates that if such illegal practice was abolished in Brazil, the country would raise around R$ 30 billion and would generate more than 2 million jobs. Luiz Paulo Barreto, executive secretary for the Ministry of Justice said that the increase in seizures is due to border operations. He also added that “"It's a mistake to think that piracy is only restricted to CDs and DVDs” explaining that piracy is linked to organized crime and, it has become more sophisticated. According to the report, in the last three years, the number of medicines seized increased from 322 thousand to 18 million. The most commonly found are those for erectile dysfunction, anabolic steroids and anti-obesity treatment.

Primera Exposición de Denominaciones de Origen de México

El 5 de diciembre recién pasado tuvo lugar la inauguración de la Primera Exposición de Denominaciones de Origen, realizada en las instalaciones centrales de la Secretaría de Agricultura, Ganadería, Desarrollo Rural, Pesca y Alimentación de México (SAGARPA). La institución informó que México tienen 13 declaratorias de protección concedidas por el Instituto Mexicano de la Propiedad Industrial (IMPI) que corresponden al Ámbar de Chiapas; Bacanora de Sonora; Café de Chiapas y de Veracruz; Charanda de Michoacán; Chile Habanero de la Península de Yucatán: Mango Ataulfo del Soconusco, Chiapas; Mezcal de Guerrero, Oaxaca, Durango, San Luis Potosí y Zacatecas; Cajitas de Olinalá, Guerrero; Sotol de Chihuahua, Coahuila y Durango; Talavera de Atlixco, Cholula, Puebla y Tecali; tequila de Jalisco, Nayarit, Michoacán y Tamaulipas, y vainilla de Papantla.

Las Denominaciones de Origen son una oportunidad para consolidar a los productos mexicanos en mercados internacionales y darles un valor agregado por el sólo hecho de haber sido producidos en el país, aseguró el Director General de Fomento a la Agricultura de la SAGARPA, Simón Treviño Alcántara.

En el evento, el funcionario de la SAGARPA afirmó que a través de la Subsecretaría de Agricultura se han otorgado diferentes apoyos, desde la producción primaria hasta la comercialización. “Un ejemplo de ello, son los Sistemas Productos Tequila, Mezcal, Café, Vainilla, Mango y Chile, a los que se fomenta en su competitividad”. Dentro de las actividades se encuentran los Apoyos y Servicios a la Comercialización Agropecuaria (ASERCA) por las acciones de promoción que realiza de los productos mexicanos en ferias, exposiciones y muestras nacionales e internacionales. Respeto de las DO recientemente otorgadas, como la vainilla de Papantla y el chile habanero de la Península de Yucatán, se llevan a cabo estrategias para impulsar su presencia en los mercados internacionales y para productos como café, mango ataulfo, sotol, bacanora o charanda se desarrollan esquemas para consolidar su preferencia en México y el extranjero.

El Vicepresidente de la Asociación Nacional de Denominaciones de Origen, Roberto Carlos Azuara, reconoció la labor del Gobierno Federal por el impulso a las Denominaciones de Origen, mismas que fomentan la producción. Explicó que en años recientes se ha fortalecido la presencia de los productos mexicanos, especialmente agroalimentarios, en los mercados internacionales debido a las acciones de promoción comercial que se realizan.Al evento también asistieron representantes de la Secretaría de Relaciones Exteriores y del IMPI, así como productores de Chiapas, Guerrero y Jalisco, entre otros.

When trade marks and company names clash: a new experience for Argentina

The Inspección de Personas Jurídicas, the authority in charge of approving the incorporation of legal entities in Argentina, was asked by Farmacia Ahorro SA,  to approve the incorporation of a sociedad anónima under its name.  Energia y Vida de Argentina SA, the proprietor of the trade mark FARMACIA DEL DR AHORRO, filed a request for this application to be rejected., relying on Article 59 of Resolution (6) IGJ (7/05), under which a company name may be rejected where it is "objectively known" by the Inspección de Personas Jurídicas to be a notorious mark.

Energia y Vida's request was initially rejected and that decision was upheld on appeal. The Inspección however considered that, as the name Farmacia Ahorro SA had already been approved by the time Energia y Vida filed its request, the matter could be decided only by the courts. An appeal has since been lodged and is currently pending.

According to Jorge Otamendi (G. Breuer) this is the first time that the Inspección has dealt with a conflict between a name and a mark. He concludes that it's not clear what lessons can be drawn from its decision though: evidence showing the notoriety of a mark filed before the company name has been approved will be considered by the Inspección, but the fact that the notoriety of the mark must be "objectively known" by the Inspección suggests that such notoriety must be of public knowledge.

Argentinean lionesses do defend well not only on the field

The Argentinean Division II of the National Chamber for Federal Civil and Commercial upheld the ruling made in a lawsuit where the trade mark ‘las leonas’ was opposed to.

The party involved in the case was the Argentinean Confederation of Hockey on Grass and Track and the ruling authorized the team to use the trade mark "las leonas" for some of their clothing. The case was brought by the right holder of the trade mark ‘leonine’ used in shoes and sandals considering that the trade mark ‘ las leonas’ could cause confusion in the consumers eyes.

However, one of the chambermaid alleged that the name ‘las leonas’ was already a household name, gained by the female hockey team due to their fame and popularity and the use of 'las leonas' was extended to products marketed under the team’s name. He continues adding that there is a certain level of recognition and acceptance by the general public and so potential buyers of the brand ‘las leonas’ would not fall unto some confusion as to the source of the product.


In this regards, Judge Alfredo Silverio Gusman said: "The framework proposed by the plaintiff has a clear distinctive character that gives it enough merit. As such, I consider that this in itself provides a significant data for the differentiation of the words in dispute.” He explained that the lack of a conceptual element can produce confusion, but this also can contribute, if present in one of the trade marks, as an appropriate way to distinguish it – or as in this case both of the marks have a proper concept. To my English speaker, in the present case the word ‘las leonas’ is a noun in plural -name given to the female lions; while ‘leoninas’ is an adjective which refers to lionesses and which implies something that is exorbitant, excessive and in law can be used to describe a contract in which all benefit is attributed to one party.

IMPI closes down two commercial establishments

The Mexican Institute of Industrial Property (IMPI) taking its duties very seriously – that of safeguarding the legitimate interests of Intellectual property rights’ owners, has closed down to commercial establishments that were apparently infringing IPRs.

The first establishment is situated in Toluca. On October 12th IMPI imposed a provisional measure against JOSÉ FERNANDO NAVARRO
SÁNCHEZ. What about? The administrative action was brought by COMUNICACIONES NEXTEL DE MÉXICO, S.A. DE C.V., (registered under 682266) that provides services such as the marketing of mobile service phones and their accessories, against Jose Fernando Navarro Sanchez, to stop him using the trade mark 'NEXTEL Y DISEÑO' under which he also offered the same services as the claimant party. As Mr Navarro appeared not to have stopped using the trade mark, on 25th November, IMPI paid an inspection visit to Mr Navarro to verify compliance with the interim previously filed, however, Mr Navarro ignored the ban ordered by the IMPI, and so, IMPI gave a fine of two thousand days of the general minimum wage in Mexico City, and again ordering immediately abstain from continuing to offer its services under the aforementioned trade mark. On November 28, 2011, and since the Mr Navarro persisted in using the trade mark IMPI proceeded to close temporarily the establishment – 30 days.

On the same line, but in another town – Cuernavaca, a business was offering services under the trade mark ‘REPRESENTACIONES TURÍSTICAS BOJORQUEZ’ (TOURIST REPRESENTATIONS BOJORQUEZ). The application against this company was made by Armando de Jesus Bojorquez Patron who owns the registered mark ‘BOJORQUEZ Y DISEÑO’ for travel services (registration 660,853). Previously, IMPI imposed a fine to ‘REPRESENTACIONES TURÍSTICAS BOJORQUEZ’ for the same cause but as it kept using the trade mark IMPI is now imposing a different penalty, i.e. temporary closure of the business.

Jurisprudencia: El efecto sorprendente es ilegal y no determina el nivel inventivo de una patente

Un reciente fallo de casación en el fondo de la Corte Suprema de Chile ha resuelto un asunto de gran interés teórico y práctico relacionado con el rechazo de una solicitud de patente de invención de procedimiento, antes concedida en tres registros distintos (EE.UU., Canadá y Aripo). 

La sentencia se relaciona con el requisito de fondo de patentabilidad denominado “nivel inventivo” (art. 32) y su apreciación por la sana crítica, así como con cuestiones relativas a la bilateralidad de la audiencia en el proceso de discusión pericial y la fuerza del informe del perito en la resolución administrativa que resuelve las concesiones de patente, estableciendo, finalmente, la inexigibilidad de la producción de un “efecto sorprendente” de la solución técnica (así exigido en la práctica por los informes periciales y resoluciones incluso del Tribunal de Propiedad Industrial), como un elemento ajeno al estándar legal de la altura inventiva. Se estimaron vulnerados los artículos 7, 16 y 35 de la Ley de Propiedad Industrial de Chile (19.039).

En efecto, la sentencia resuelve que “[el] artículo 35 de la Ley 19.039, dispone que, para determinar si una invención tiene nivel inventivo, se debe considerar si para una persona normalmente versada en la materia técnica correspondiente, ella no resulta obvia ni se habría derivado de manera evidente del estado de la técnica".Esto significa que “el nivel inventivo corresponde a una determinación subjetiva que debe realizar el sentenciador sobre la base de un criterio objetivo, cual es, la perspectiva de una persona normalmente versada en la materia técnica correspondiente y de acuerdo al nivel de conocimiento existente a la fecha de la prioridad y no aquél al que hubiere evolucionado a la fecha de análisis pericial”. 

De esta manera el Tribunal de Propiedad Industrial -de segunda instancia- con "el fallo impugnado ha infringido el artículo 16 de la Ley N° 19.039, con influencia sustancial en lo dispositivo del fallo, en razón de que la errada apreciación de los antecedentes del proceso produjo la contravención formal del artículo 35 de la cita ley, pues se ha procedido a negar el registro de una solicitud, aplicando y exigiendo acreditar, para determinar el nivel inventivo, una categoría que van más allá de lo que requiere la ley [el efecto sorprendente]".

La Corte Suprema casando el fallo de instancia resolvió además que los jueces "al resolver el asunto controvertido, deben ponderar el informe pericial, el que constituye un antecedente más de aquellos que, se deberán valorar; es decir, la ponderación debe serlo de manera global, abarcando todos y cada uno de los antecedentes allegados, ajustada a criterios de racionalidad y de la experiencia, que consideren el valor conjunto de todos ellos y no solo de uno o algunos, de manera que permitan resolver adecuadamente el asunto". 

Así "al considerar, únicamente, las razones técnicas dadas por el perito, para concluir que la presente solicitud de invención, carece de nivel inventivo, omitiendo toda consideración a los principios de la lógica y las máximas de la experiencia que correspondía aplicar, prescindiendo en su análisis, de los elementos de convicción que estaban llamados a valorar, han infringido las normas que gobiernan el sistema de ponderación judicial de la prueba que dispone el artículo 16 de la Ley 19.039" .

Además. los jueces de la instancia, desatendieron el principio de bilateralidad de la audiencia (audiatur altera pars) alegado por el solicitante -recurrente- "en cuanto a que se vio impedido de ejercer su legítimo derecho a formular las observaciones que resultaban pertinentes sobre la materia, ya que, no se le otorgó el traslado respectivo, del referido informe pericial, infringiéndose de esta forma, lo dispuesto en el artículo 7 de la ley". 

Finalmente el fallo nos recuerda que "si bien los jueces de la instancia son soberanos al establecer los hechos, no es procedente aceptar que en tal análisis puedan prescindir de elementos de convicción que están llamados a valorar, pues al hacerlo así, desde luego infringen las reglas de la sana crítica".

La sentencia -que puede considerarse "de escuela"- entró a conocer del fondo del asunto mediante el expediente de la infracción de leyes reguladoras de la prueba (en este caso regidas por la sana crítica), estableciendo varios principios que es bueno recordar: el procedimiento de concesión de patente es un procedimiento administrativo que deviene en judicial especial al momento de trabarse una controversia entre el solicitante y la administración y está íntegramente regulado por el principio de legalidad. 

Los informes periciales contienen dictámenes técnicos que, junto con otros antecedentes del proceso -en este caso documentos de patente y registros previos- configuran los elementos de convicción del registrador que obra como juez especial, quien debe ponderarlos de acuerdo con el estándar de la sana crítica, exigencia que se hace extensiva al Tribunal de Propiedad Industrial. 

Por su parte, el estándar legal contenido en los requisitos de fondo (novedad, nivel inventivo y aplicación industrial) son los únicos a los que se debe recurrir, tanto por los peritos como por los sentenciadores, para acoger o rechazar un derecho de exclusiva de esta clase, estimando al ya conocido "efecto sorprendente", como una exigencia ilegal, más allá que se trate de una interpretación del concepto jurídicamente indeterminado "persona normalmente versada en la materia técnica". Esta última expresión es un ideal abstracto (tal como "el buen padre de familia") que sirve de referente para el evaluador técnico y el resolutor, que en la práctica chilena ha devenido en la exigencia de la producción en el evaluador de un efecto sorprendente por parte de la realización respectiva, como una forma de medir la falta de obviedad de una determinada realización. Su utilización, en consecuencia, ha sido considerada por la Corte Suprema como ilegal (más allá de ser una práctica habitual, que no configura derecho porque la ley no se remite a ella), al no someterse al principio de legalidad que rige las actuaciones de las instituciones públicas.

Brazil’s ‘got a lovely bunch of’...melons

The Brazilian Instituto Nacional da Propiedad Industrial (INPI) received on Monday 28th of November, another application for Geographical Indication, this time for ‘Melon of Rio Grande do Norte’ located in the region of Mossoró. INPI informs that the request was sent by Francisco de Paula Cipriano Second from the Executive Committee of the Fruits of Rio Grande do Norte (Coex); Marine Franco Ramos, project manager; and Lorena Alves both from SEBRAE / RN.

The application of GI is in the form of Indication of Source (Indicação de Procedência). There are two forms of GIs in Brazil: Indication of Source and Denomination of Origin. The indication of source is characterized by the geographical name which is known for production, extraction or manufacture of a product. The 'mossoroense' melons are well known in Brazil but is important to mention that the whole location ‘Rio Grande do Norte’ is known “as the largest producer in the country of melon and fruit in general, and it is of great economic importance to the state”. I guess then that we will be expecting more fruits from this region to come and applied - no coconuts though.

INPI Resolution 075 of November 28, 2000 establishes the procedures for the registration of Geographical Indications.

I feel that melons are as cheeky as coconuts- that is the reason I remember the song "I've Got A Lovely Bunch Of Coconuts" written by Fred Hetherton and interpreted by many singers...even by the muppets! The point been that you cannot sing this without smiling, and every time I bring news for one of the Latin American countries in the area of GIs it makes me smile.
