Encounter 23: IP Enforcement and Cybersecurity

On 13 December 2022, FIDE (Legal and Business Research Foundation) and TIPSA (Transatlantic Intellectual Property Academy) will hold the Encounter 23: IP Enforcement and Cybersecurity.

The panellists are Richard Lane (World Intellectual Property Organization) and Prof. Tal Zarsky (University of Haifa’s Faculty of Law). Prof. Manuel Desantes (University of Alicante) will moderate the session.

The suggested readings and the report on the session will be available on the Global Digital Encounters (GDE) website as time goes by.

IP Border Measures

Last week the blog brought you some news regarding counterfeit medicines. In the same article, it was posted a moot question enquiring generic medicines and the scope of IP legislation when the medicines were placed in other countries.

Thanks to Xavier Seuba , the IP Tango blog is now aware of a working paper which examines the nature of this situation (the paper was commissioned by the International Centre for Trade and Sustainable Development (ICTSD) and written by Xavier himself). While the paper, titled “Border Measures Concerning Goods Allegedly Infringing Intellectual Property Rights: The Seizures of Generic Medicines in Transit”, focuses and analyses the EC Regulations, it is indeed of help for the Latin American countries. This is so, because the document studies the territorial nature of IPRs as well as the WTO obligations and the TRIPS agreement and of course the matter of free trade.

I do not doubt that the paper as such is good material for those of you who work in this area. I do indeed recommend the article and you can benefit from it here.

Enforcement of IP rights in Argentina

A short but informative English-language summary of the law and practice on enforcement of IP rights in Argentina has been posted on the Mondaq legal news service. Written by Andres Moncayo Von Hase (Bruchou Fernandez Madero & Lombardi), the article explains the position in Argentina post-TRIPs and concludes that, while there is still much to be done, the country is edging towards a genuine IP culture.

MEXICO: Nueva Sala Regional en Materia de Propiedad Intelectual.

Nuevamente nuestros incansables amigos de ALHEN nos pasan ésta interesante noticia.

El Tribunal Federal de Justicia Fiscal y Administrativa ha modificado su Reglamento Interior, creando una Sala Regional en Materia de Propiedad Intelectual que tendrá competencia en todo el territorio nacional y sede en la Ciudad de México, Distrito Federal.

Esta nueva Sala tendrá competencia material especializada para tramitar y resolver los juicios que se promuevan contra las resoluciones dictadas con fundamento en la Ley de la Propiedad Industrial, en la Ley Federal del Derecho de Autor, en la Ley Federal de Variedades Vegetales, así como en los demás ordenamientos que regulan la materia de Propiedad Intelectual.

US ambassador politely criticises Belize over IP failure

7 News reports from Belize on the seventh annual US Embassy exhibition, “Made in the USA”, to encourage Belizean importers to buy more. According to the report, Robert Dieter (US Ambassador to Belize) said:

“Belize should continue to strengthen its institutional capabilities and competitiveness. This includes respecting international law that comes with participating in a world economy such as enforcing intellectual property rights. However in previous years the perception of corruption has reduced the nation’s performance indicators. This is something that must change if Belize is to move forward in a meaningful way with its own economic development.”
