Confirmada la revocación de la patente del frijol “Enola”

Según nos informa Néstor Morera (Morera Abogados), finalmente se ha confirmado la revocación de la patente Nº 5,894,079 solicitada en los Estados Unidos sobre un frijol latinoamericano.

El 10 de julio de 2009, el Tribunal de Apelaciones de los Estados Unidos para el Circuito Federal determinó que la patente estadounidense sobre el frijol Enola no es válida porque ninguno de los reclamos de la patente cumple con el criterio de “no obviedad”.

Como oportunamente os informamos, el denominado frijol “Enola” fue solicitada por el estadounidense Larry Proctor intentando apropiarse en exclusiva de un material existente desde hace tiempo en los países de Latinoamérica.

Nuevos tiempos para la propiedad intelectual en Ecuador


Según nos cuenta nuestro amigo Alfonso Rivera, corren nuevos tiempos para la propiedad intelectual en Ecuador. Según informa Confirmado.net, "Rafael Correa, anunció que se está fortaleciendo el Instituto Ecuatoriano de Propiedad Intelectual (IEPI) para romper el paradigma neoliberal que buscaba apropiarse hasta de los conocimientos". La propiedad intelectual debe servir para el desarrollo de los pueblos. Por consiguiente, las leyes no deben privilegiar los negocios antes que los derechos humanos. La intención es favorecer el otorgamiento de licencias obligatorias, algo que ya está contemplado en la legislación vigente, para la elaboración de medicinas genéricas, agroquímicos y “todo lo que sea posible, sobre todo en cuestiones de derechos humanos”.

Revolucionaria patente chilena

Por nuestros amigos de Marcasur nos hemos enterado que una empresa chilena ha obtenido una importante y revolucionaria patente.

La empresa chilena TCPavements obtuvo recientemente la concesión de una patente sobre un método de construcción de losas para pavimentos, que prolonga su vida útil y reduce significativamente los costos de inversión (construcción y mantenimiento).

La solicitud chilena de patente fue presentada en 2005 ante el Instituto Nacional de Propiedad Industrial (INAPI) y luego de cumplir con todos los exámenes e informes periciales establecidos legalmente fue finalmente concedida por un plazo de vigencia de 15 años, con expiración en el año 2024. En cuanto a su alcance, el derecho de exclusividad conferido a Inversiones Yuste S.A. protege tanto el método de fabricación como las losas obtenidas mediante el mismo.

I Foro de Sociedades de Gestión Colectiva del Ecuador (Guayaquil, 15-16 Julio)

Designación de la OEPM como ISA e IPEA por parte de Chile y Perú.

Los pasados días 2 y 6 de junio se hicieron efectivas las adhesiones al Tratado de Cooperación en materia de Patentes (PCT) de Chile y Perú, respectivamente. Esto significa que los solicitantes de patentes españoles gozarán, a partir de ahora, de un procedimiento simplificado para solicitar la protección de sus invenciones en los mencionados países.

Además, ambos países han designado ya a la Oficina Española de Patentes y Marcas como Administración encargada de la Búsqueda Internacional (“ISA”, por sus iniciales en inglés) y del Examen Preliminar Internacional (“IPEA”), para las solicitudes PCT recibidas en sus Oficinas nacionales.

Vale dos Sinos recognised as a protected geographical indication

It is estimated that Brazilian leather industry represents a US$ 2 billion business and currently employs approximately 65,000 persons. Today Brazil produces nearly 45 million processed leather goods annually. Vale dos Sinos, in the State of Rio Grande do Sul (southern Brazil), accounts for 40% of this production.

Last month, the Brazilian Patent and Trademark Office (BPTO) recognized Vale dos Sinos as a Protected Geographical Indication (PGI) for finished leather. This is the first PGI for non-agricultural products registered in Brazil.

The BPTO has already declared as local PGIs (i) Vale dos Vinhedos (in Rio Grande do Sul) for wines, (ii) Região do Cerrado Mineiro (in Minas Gerais) for coffee, (iii) Pampa Gaúcho da Campanha Meridional (in Rio Grande do Sul) for bovine meat and derivatives and (iv) Paraty (in Rio de Janeiro) for Aguardentes, tipo cachaça e aguardente composta azulada, a distilled beverage obtained from the sugar cane.

In the same track goes Vale do Submédio São Francisco, approved in the meantime by the BPTO as a PGI for grapes and mangos. At this moment, there are now seven Geographical Indications applications pending at the BPTO ranging from coffee, water to electronic equipments.

The use of Geographical Indications for designating local produces has caught the attention of the Brazilian people and it appears that the success of Vale dos Vinhedos for wines (this being the first national PGI, granted in 2002) and the economic benefits generated by the growth rate of tourists in the region between 2002 and 2007 (almost 170%) is one of the reasons for the steady increase of GIs in Brazil.

The New Customs Regulation and the Current Practice of Customs Authorities

There was published on February 5 a the new Brazilian Customs Regulation, which provides the legal framework for importing and exporting goods from Brazil.

Decree 6,759/2009 has not brought any significant change when compared with the previous Customs Regulation (Decree 4,532/2002), especially in what concerns anti-piracy activities and IP rights infringement. In that matter, it maintained the right of the Customs authorities to conduct searches and seize “ex officio” counterfeit products that violate trade mark rights. This Regulation has not however extended such seizure right to goods that infringe third parties’ patents, industrial designs and copyrights. Thus an “ex officio” seizure order cannot be freely issued by Customs Authorities when the pirate product infringes patents, industrial designs and copyright.

Such omission has been subject of stringent complaints about IP owners, since this limitation significantly increases the difficulties to refrain counterfeit practices in Brazil, taking into account that seizure will only take place with the issuance of a Court order.

Further, customs authorities of the Port of Santos have been interpreting restrictively Decree 6,759/2009 by seizing “ex officio” goods that only infringe trade marks that are registered at the Brazilian Trade Mark Office (BTO). Hence, counterfeit goods infringing renowned trade marks not yet registered at the BTO will not be subject of seizure.

The rationale behind this understanding is that a trade mark application only grants to the applicant an expectation of such mark being registered and that the protection conferred is provisional, which cannot be the same as to the one provided to the holder of a registered trade mark.

Attorneys, scholars and IP owners are consistently opposing to such understanding based on Art. 198 of the Brazilian IP Law. This article states that the seizure of counterfeit products should take place whenever those products are identified by “trade marks”, without determining whether the trade mark is registered or not.

In this regard, Item III of Article 130 of the Brazilian IP Law also grants to trade mark applicants the right to take the necessary measures to secure the reputation and integrity of their marks. This should include the right to request the customs authorities to undertake an “ex officio” seizure of counterfeit products identified with the mark under examination.

The BTO normally takes between 2 and 4 years to register a trade mark. In the meanwhile, it appears that the trade mark applicant will have to stoically watch the entrance of counterfeit goods and must compete with them in the same market. It is expected that such restrictive interpretation will be soon challenged in Court to avoid more harmful practices.

Patents and biological sequencing in Brazil

On 7 May 2009 the Brazilian Patent Office (BPO) published Resolution 210/2009, which establishes the new standard procedure for the presentation of nucleotides and amino acids sequence listings in patent applications. This resolution revokes the provision regarding the "Listing of Biological Sequences" of Normative Act 127/97.

Under the new Resolution, the presentation of nucleotides and/or amino acids sequence listings should follow WIPO’s Standard ST. 25. The sequence listing should be submitted at the filing date of the patent application, or no later than the date of the examination request, in a computer readable form (CD or DVD), in TXT and PDF format.

A printable copy may be additionally submitted at the filing date, attached to the specification. The applicant that has submitted the sequence listing in a printed form before the issuance of this resolution may also submit it in a electronic format, in compliance with this Resolution. This Resolution comes into force on 1 September 2009.

Venezuela: Más sobre la nueva legislación de propiedad intelectual


Tal y como hemos ido informado en IP Tango, tras el abandono de la Comunidad Andina, Venezuela está en un proceso de revisión de su legislación de propiedad intelectual. Existe muy incertidumbre y preocupación por parte de los distintos despachos de abogados y de los inversores extranjeros. Gracias a Alfonso Rivera, en IP Tango hemos tenido acceso a una información que no resta sino que suma mayor incertidumbre a esta situación: "El ministro de Comercio confirmó el jueves pasado que el Gobierno promulgará una nueva ley de propiedad industrial. Según explicó, la intención es adecuar el texto legal al Acuerdo sobre los Derechos de Propiedad Intelectual Relacionados con el Comercio (Adpic) de la Organización Mundial del Comercio (OMC), así como de otros convenios internacionales suscritos por el Estado venezolano". Si esto fuera cierto, quizás deberíamos interpretar que la Decisión 468 de CAN no cumplía con ADPIC, cosa que resulta harto difícil de sostener.
