Peru: modernizing IP registration

The Peruvian Intellectual Property Office (INDECOPI) announced that the Council of Ministers’ President approved the new Regulation of the National Registry of Copyright, including a ‘virtual’ system of registration of copyright and related rights. The new Regulation allows user to apply for registration 24 hours a day.

This new electronic system ‘unifies, simplifies and rationalizes the requirements to be asked of citizens, as it is part of the rules of simplification and rationalization of the administrative procedures’. INDECOPI gives some examples: the system of notifications will be done through an electronic platform which requires the applicant to submit their e-mail which will be used for communications and so, speeding the process.

It is noted that one of the aims brought by this decree (No. 053-2017-PCM) is to incentive people to register their ‘intellectual, artistic, technical and scientific works.’

In the same vein, INDECOPI remembers the public that there is a free advisory platform specialized in copyright which is led by experts from the Copyright Office.

Brazil announces the beginning of electronic filing for industrial designs

The weeks have been busy at the Brazilian Intellectual Property Office (INPI). After some news about patent guidelines, INPI published on the April 7^th Official Gazette (RPI 2309) the Resolution # 146/2015 (Resolução nº 146/2015), instituting the electronic system for industrial designs. According to the resolution, the electronic filing for industrial design applications will become available on April 22, 2015.

INPI has progressively been improving their electronic systems. In 2006, INPI started with the “e-Trademarks” (e-Marcas) for trademark applications, with an update to its 2.0 version in 2011. As reported here, from July 2011 INPI started testing its “e-Patent “(e-Patentes) system by allowing users to access “Cartas Patentes” (patent letters). Although scheduled for 2012, it was in 2013 that INPI put up in the air the e-Patent system officially. In October 2014, INPI started facilitating access to online search system of trade marks, patents, industrial designs, and computer programs. The industrial design system is the latest step taken by the INPI towards a total digital environment.

INPI electronic systems are part of INPI’s efforts to expedite patent and trademark prosecution in order to reduce its backlog. These systems allow users to file applications electronically and have some online access to prior art documents and technical opinions issued by examiners, among other services provided by the Office.

INPI’s website provides quite some interesting data about the current use of the “e-Trademarks” and “e-Patent”. As per the tables, you can see that there is a growing interest in the use of the systems, culminating in 74% of the trademark and patent applications being currently filed electronically.

It is important to remember, however, that in Brazilian Law industrial design applications are not subjected to substantive examination. Therefore, it is really possible to expect an immediate impact of the new system. Currently, INPI takes an average one and a half year for granting industrial designs, but with the new system we can hope the INPI will be able to significantly decrease the existing industrial design backlog.

México: IMPI tiene nuevo sistema de solicitudes de "Marca en Línea"

Actualmente en el portal web del IMPI se pueden consultar electrónicamente, las bases de datos y expedientes de marcas, patentes y procedimientos contenciosos del Instituto, además de realizar los pagos de las tarifas por los servicios institucionales de forma remota. A partir de mañana viernes 28 de septiembre de 2012, el IMPI pondrá en operaciones el sistema denominado "Marca en Línea", que estará disponible a través del portal www.impi.gob.mx.

El sistema Marca en Línea ofrece a los usuarios una vía moderna, cómoda y segura para realizar el llenado, pago y presentación de solicitudes de marca, marca colectiva, avisos y nombres comerciales ante el IMPI, desde cualquier lugar, e incorporando la Firma Electrónica Avanzada (FIEL), evitando así su desplazamiento a las instituciones bancarias y al Instituto.

Con esta herramienta el IMPI busca incrementar su eficiencia, transparencia, accesibilidad y capacidad de respuesta a las demandas de los ciudadanos, empresas y demás usuarios del sistema de Propiedad Industrial mexicano. Además, se espera reducir en 90% los errores que los usuarios llegan a cometer al llenar una solicitud de marca, marca colectiva, aviso y nombre comercial, reducir los trámites inherentes a correcciones o enmiendas de forma, disminuyendo los costos para los usuarios por concepto de contestación a oficios de requisitos de forma, evitar que las solicitudes se presenten incompletas, ya sea por falta de documentos, pagos incompletos, entre otros y disminuir el número de oficios que el IMPI emite por requisitos de forma, y por consiguiente, reducir la cantidad de papel que el Instituto consume en esta actividad.

Para acceder a la presentación en línea deben cumplirse los siguientes requisitos previos:

1. Ser usuario registrado en el Portal de Pagos y Servicios Electrónicos (PASE) del IMPI

2. Contar con la Firma Electrónica Avanzada (FIEL).

3. Cumplir con formatos: GIF para imágenes y .PDF para documentos.

Procedimiento:

1. Entrar a la página del IMPI (www.impi.gob.mx), seleccionar la opción Marca en Línea o acceder por el

PASE https://eservicios.impi.gob.mx/seimpi/action/inicio.

2. Ingresar con el nombre y contraseña del PASE (en caso de no contar con ellos se deberá dar del alta en el portal del PASE).

3. Capturar la información requerida y, en su caso, adjuntar los documentos procedentes.

4. Realizar el pago vía Internet.

5. Firmar electrónicamente la solicitud, a través de la FIEL.

6. Enviar la solicitud al Instituto.

7. Verificar el acuse de recibo disponible en el Tablero Electrónico del PASE.

México: anuncian que antes de 2013 se podrán registrar marcas vía Internet

Antes de que concluya este año, el Instituto Mexicano de Propiedad Industrial (IMPI) lanzará como nuevo servicio el registro de marcas online, como un trámite alternativo y opcional para las empresas.

Durante una reunión privada con miembros de la Barra Mexicana Colegio de Abogados, Eliseo Montiel, director divisional de marcas del IMPI, afirmó que con esta herramienta las empresas ahorrarán tiempo y dinero, ya que se reducirá el número de requisitos para el registro de las marcas. Detalló que el registro en línea se hará en dos etapas, la primera es la presentación de solicitud, la cual se hará a través de la Firma Electrónica Avanzada (Fiel). Posteriormente y en una segunda etapa, el IMPI evaluará la información, y eventualmente otorgará el registro.

Rodrigo Roque, director general del IMPI, dijo que ésta es una iniciativa del Gobierno federal encaminada a hacer todo electrónico.

Por su parte, Jesús Vega Herrera, titular de la oficina regional Sureste de ese organismo, considera que para concretar este propósito hace falta la infraestructura electrónica, así como la capacitación del personal y usuarios. “Nos tomó por sorpresa el anuncio hecho en México sobre el registro de marcas por Internet, porque si bien es algo en lo que se está trabajando, no hay un plan de cómo se va a hacer y cómo va a operar”, dijo. Agregó que si bien esta medida permitirá a los usuarios saber en qué fase del proceso se encuentra su trámite, los tiempos de respuesta no se acortan, sino que permanecen igual: hasta 6 meses para dar una primera respuesta.

“Hay que considerar que México forma parte del protocolo Madrid, en el que participan 85 países, y donde se establece que en un solo trámite se tiene todo y para ello se requiere infraestructura y capacitación. Antes todo se hacía en ventanilla, pero hoy se puede dar seguimiento a la solicitud por Internet, pero hay que llevar a las oficinas los papeles de la solicitud. La transición será a que el registro sea en línea, a que se eliminen los papeles y que desde una computadora se pueda hacer el pago y se tenga el monitoreo a través de la página http://marcanet.imipi.gob.mx”, precisó.
