Panama boosts its international IP commitments

7 September 2012 is an important day for intellectual property rights in Panama. On that date, the Republic's commitment to three international instruments take effect. The details can be found in the following World Intellectual Property Organization (WIPO) Notifications:

Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure - Accession by the Republic of Panama: Budapest Notification No. 286
Patent Cooperation Treaty (PCT) - Accession by the Republic of Panama: PCT Notification No. 201
Trademark Law Treaty - Accession by the Republic of Panama: TLT Notification No. 58

Brazil: Patent Cooperation System

This April, the Brazilian Instituto Nacional da Propriedade Industrial (INPI) will launch a new system that will allow faster registration of patent applications coming to the Institute from the outside - via Cooperation Treaty (PCT), which will help to accelerate the process. This system called the Data Acquisition System PCT (SISAD-PCT) provides automatic data acquisition with access to all information of a PCT application, by communicating with the database of the World Intellectual Property Organization (WIPO).

In the first stage the system will be used to fill in applications with dates of deposits between 2006 and 2009. In addition, the tool will allow the inclusion of information that may have been omitted, referring to the inventors or applicants and priorities. It is hoped that this first stage should be completed in the first half of April.

The second stage, still under study, provides for the incorporation of the SISAD-PCT into SINPI (internal system containing bibliographic data), in order to facilitate the registration since the beginning of PCT applications.

Chile signs up to PCT

Chile became the 140th Patent Cooperation Treaty (PCT) Contracting State on 2 March 2009. The PCT will enter into force for Chile on 2 June 2009. IP Tango learns that further information will be published in the March issue of the PCT Newsletter and in a WIPO Update.

Another poor year for LA patent applications

The World Intellectual Property Organization press release Global Economic Slowdown Impacts 2008 International Patent Filings contains lots of statistical data concerning the extent of Patent Cooperation Treaty filings. Of the 139 countries that are part of the International Patent system, developing countries account for about 70%, but file very few applications.

Developing countries make up 78% of the membership of the PCT, representing 109 of the 139 countries that have signed up to the treaty to date. 163,800 applications were made in 2008, but a little over 150,000 of these came from the top 15 industrial nations, leaving little over 12,000 applications between the other 124. Of the Latin American economies, Brazil was ahead with 451 PCT applications, followed by Mexico on 210.
