AIPPI’s Platform for Online Resources & Publications

The International Association for the Protection of Intellectual Property (AIPPI) launched a Platform for Online Resources & Publications.

The platform is user-friendly and contains “almost 4,000 publications”.

The main elements to perform a search are the featured collections, the basic and advanced searches.

The featured collections include inter alia Committee Publications, Summary Reports, Study Guidelines, Amicus Briefs submissions and Resolutions adopted by AIPPI (classified per topic: patents, trademarks, copyrights, trade secrets, designs and general).

AIPPI announced that the “National and Regional Group Reports for the 2020 Questions” are already available on the platform.

Old + New = learning experiences

There is a new cooperation agreement signed between the old and the new world. Mr Luiz Otávio Pimentel, the Brazilian Instituto Nacional da Propriedade Industrial (INPI)’s president recently signed a cooperation agreement with the UK Intellectual Property Office (UKIPO). The aim of this agreement is to exchange experiences, and of course, collaboration between the offices and the quality of examinations procedures.

The exchange of experiences is based on the role of the Academy (the Educational sector) centring in the significance of intellectual property to society. In order words, the role that it has in raising awareness about intellectual property issues. Back in November 2015, the UKIPO launched a webpage “giving schools and colleges access to teaching resources to help students learn about intellectual property.” The project was funded by the European Intellectual Property Office (EUIPO, previously known as OHIM).

The INPI and UKIPO agreement is also to exchange of information on The Patent Prosecution Highway (PPH) - the accelerated patent prosecution procedures by way of sharing information between patent offices. Moreover, it includes the examination and study of a version adapted to Brazilian of the British Lambert Toolkit. This tool is based on universities and business collaboration agreements -- the aim is to “assist academic or research institutions and industrial partners who wish to carry out research projects together.”

Finally, Brazil and the UK Brazil exchanged their views on bilateral trade relations among other issues that took part on the Joint Economic and Trade Committee (JETCO) meeting.

Brazil announces the beginning of electronic filing for industrial designs

The weeks have been busy at the Brazilian Intellectual Property Office (INPI). After some news about patent guidelines, INPI published on the April 7^th Official Gazette (RPI 2309) the Resolution # 146/2015 (Resolução nº 146/2015), instituting the electronic system for industrial designs. According to the resolution, the electronic filing for industrial design applications will become available on April 22, 2015.

INPI has progressively been improving their electronic systems. In 2006, INPI started with the “e-Trademarks” (e-Marcas) for trademark applications, with an update to its 2.0 version in 2011. As reported here, from July 2011 INPI started testing its “e-Patent “(e-Patentes) system by allowing users to access “Cartas Patentes” (patent letters). Although scheduled for 2012, it was in 2013 that INPI put up in the air the e-Patent system officially. In October 2014, INPI started facilitating access to online search system of trade marks, patents, industrial designs, and computer programs. The industrial design system is the latest step taken by the INPI towards a total digital environment.

INPI electronic systems are part of INPI’s efforts to expedite patent and trademark prosecution in order to reduce its backlog. These systems allow users to file applications electronically and have some online access to prior art documents and technical opinions issued by examiners, among other services provided by the Office.

INPI’s website provides quite some interesting data about the current use of the “e-Trademarks” and “e-Patent”. As per the tables, you can see that there is a growing interest in the use of the systems, culminating in 74% of the trademark and patent applications being currently filed electronically.

It is important to remember, however, that in Brazilian Law industrial design applications are not subjected to substantive examination. Therefore, it is really possible to expect an immediate impact of the new system. Currently, INPI takes an average one and a half year for granting industrial designs, but with the new system we can hope the INPI will be able to significantly decrease the existing industrial design backlog.

Brazil: Progress and looking ahead -- facilitating online services

The Brazilian Instituto Nacional da Propiedade Industrial (INPI) is now facilitating access to online search system of trade marks, patents, industrial designs, and computer programs. It all started last Tuesday, October 14.

There is a direct link and thus access to the database without going through login/password page. However, if you would like to have access to a wider content and thus, production of documents, you should register. This latter appears to be a straightforward and easy process i.e. just filing out certain details – as far as I am aware nothing to do with ‘payment/fee’ details as the Venezuelan IP office requires (see previous post here).

Registration, while not crucial, comes divided into three sectors: 1.- Client (natural or legal person domiciled in the country); 2.- Lawyer or Attorney without special qualification (representing a client in the requested services); and 3.- Industrial Property Agent.

This new addition complements previous online services such as: ‘e-marcas, electronic view of petitions, and ‘push’.

México: IMPI tiene nuevo sistema de solicitudes de "Marca en Línea"

Actualmente en el portal web del IMPI se pueden consultar electrónicamente, las bases de datos y expedientes de marcas, patentes y procedimientos contenciosos del Instituto, además de realizar los pagos de las tarifas por los servicios institucionales de forma remota. A partir de mañana viernes 28 de septiembre de 2012, el IMPI pondrá en operaciones el sistema denominado "Marca en Línea", que estará disponible a través del portal www.impi.gob.mx.

El sistema Marca en Línea ofrece a los usuarios una vía moderna, cómoda y segura para realizar el llenado, pago y presentación de solicitudes de marca, marca colectiva, avisos y nombres comerciales ante el IMPI, desde cualquier lugar, e incorporando la Firma Electrónica Avanzada (FIEL), evitando así su desplazamiento a las instituciones bancarias y al Instituto.

Con esta herramienta el IMPI busca incrementar su eficiencia, transparencia, accesibilidad y capacidad de respuesta a las demandas de los ciudadanos, empresas y demás usuarios del sistema de Propiedad Industrial mexicano. Además, se espera reducir en 90% los errores que los usuarios llegan a cometer al llenar una solicitud de marca, marca colectiva, aviso y nombre comercial, reducir los trámites inherentes a correcciones o enmiendas de forma, disminuyendo los costos para los usuarios por concepto de contestación a oficios de requisitos de forma, evitar que las solicitudes se presenten incompletas, ya sea por falta de documentos, pagos incompletos, entre otros y disminuir el número de oficios que el IMPI emite por requisitos de forma, y por consiguiente, reducir la cantidad de papel que el Instituto consume en esta actividad.

Para acceder a la presentación en línea deben cumplirse los siguientes requisitos previos:

1. Ser usuario registrado en el Portal de Pagos y Servicios Electrónicos (PASE) del IMPI

2. Contar con la Firma Electrónica Avanzada (FIEL).

3. Cumplir con formatos: GIF para imágenes y .PDF para documentos.

Procedimiento:

1. Entrar a la página del IMPI (www.impi.gob.mx), seleccionar la opción Marca en Línea o acceder por el

PASE https://eservicios.impi.gob.mx/seimpi/action/inicio.

2. Ingresar con el nombre y contraseña del PASE (en caso de no contar con ellos se deberá dar del alta en el portal del PASE).

3. Capturar la información requerida y, en su caso, adjuntar los documentos procedentes.

4. Realizar el pago vía Internet.

5. Firmar electrónicamente la solicitud, a través de la FIEL.

6. Enviar la solicitud al Instituto.

7. Verificar el acuse de recibo disponible en el Tablero Electrónico del PASE.

Nueva plataforma online de Propiedad Industrial de Chile cofinanciada por la UE

El INAPI de Chile lanzó oficialmente hoy “INAPI Proyecta”, una plataforma pública de difusión de la propiedad industrial y transferencia de conocimiento que tiene por objetivo generar oportunidades para emprender, innovar y crear mediante el uso y la gestión de la propiedad intelectual.

El proyecto iniciado en octubre del año 2010 es parte del Programa de Innovación y Competitividad UE-Chile, ejecutado por diversas instituciones públicas para promover la innovación y el emprendimiento en beneficio del desarrollo económico del país. Este programa de cooperación, cuenta en su primera fase con un financiamiento de 18,6 millones de euros, aportados en partes iguales por la Unión Europea y el Gobierno de Chile, bajo la coordinación de la Agencia de Cooperación Internacional de Chile (AGCI). En específico, esta plataforma tuvo un costo de 584.744 euros, aportados en partes iguales por el Gobierno de Chile y la Unión Europea.

“INAPI Proyecta” integra tres componentes, con los cuales será posible acceder a guías y manuales de propiedad industrial, realizar cursos a través de una plataforma e-learning que incluye videoconferencia, así como realizar búsquedas e identificar información tecnológica en los documentos de patentes a nivel mundial en temáticas que permitan potenciar el crecimiento económico del país. El sistema dispone de herramientas orientadas a aprender, usar y transferir propiedad industrial, así como otras opciones personalizables que buscan conformar una comunidad en torno a la propiedad industrial y un ambiente de intercambio de conocimiento para los miembros asociados.

En el lanzamiento el embajador de la Unión Europea en Chile, Jaime Pérez Vidal, dijo que "la protección de la propiedad intelectual constituye un elemento fundamental para el éxito del mercado, tanto en la Unión Europea como en Chile. Es importante no sólo para la promoción de la innovación y la creatividad, sino también para el desarrollo del empleo y la mejora de la competitividad, con un énfasis en las pymes, actores clave en creación de innovación".
