Puerto Rico gears up for university-originated R&D exploitation reforms

In October of last year Puerto Rico's Legislative Assembly approved Act 150 to sponsor and promote the participation of academics, professors and researchers from the University of Puerto Rico in the development of intellectual property and the transfer of technology into industry.  The objective of this legislation is to increase research into and the development of technology in Puerto Rico's academic arena, in a broadly similar manner to that in which the Small Business Patent Procedures Act, the Bayh-Dole Act and the Cooperative Research and Technology Enhancement (CREATE) Act of 2004 have functioned in the United States.  Previously, University of Puerto Rico professors, researchers and academics were not allowed to license their innovations or work alongside commercial entities.

Paraguay – Aprueba marco jurídico para el E-commerce y el E-government.

Oscar Pavia nos informa que el pasado viernes 24 de diciembre de 2010 se publicó en Paraguay la promulgación de la Ley Nº 4.017 “DE VALIDEZ JURÍDICA DE LA FIRMA ELECTRÓNICA, LA FIRMA DIGITAL, LOS MENSAJES DE DATOS Y EL EXPEDIENTE ELECTRÓNICO”, con lo cual finalmente y tras casi diez años de lucha el Paraguay se une al mundo online con el debido respaldo jurídico

Dicha ley otorga validez jurídica a la firma electrónica, digital, mensajes de datos y el expediente electrónico.

El presidente de Paraguay, Fernando Lugo, debe reglamentar el proyecto de ley en un plazo de 90 días contados desde la citada publicación. Seguramente Oscar nos mantendrá oportunamente informados.

Rio 2016 Logo is Launched During New Year’s Eve but Controversies Have Arisen about Its Originality


Copacabana beach was again the stage of the main venue for the promotion of the Olympic Games in Rio 2016. The Brazilian Olympic Committee (COB) took advantage of the usual New Years’ eve gathering, of about 2 million people on the beach to watch the traditional fireworks display that takes place every 31st. of December, and launched the logo for the Rio 2016 Olympic games. Good marketing strategy!!!

The logo was well accepted by the “Cariocas” (Portuguese name for those who are born in the city of Rio de Janeiro) and the general Brazilian population, as the symbol represents very much the warm Brazilian way in receiving tourists in general and will, therefore, be extended to the already awaited foreign athletes: the holding of the hands express this warmth, the friendship and the happiness of the locals. Further to that, it shows the Sugar loaf, which is one of the most important postcards of the city, in a vibrating way, as if it has gained life.

The logo was conceived as a sculpture and its design was aimed to be used in 3D as well, to introduce the idea of movement. Therefore it is considered innovative in this regard.

Nevertheless, ESPN Brazil (Sports network) placed yesterday in its site (www.espn.com.br/.../167735_RECEM+LANCADA+LOGO+DO+RIO+2016+VIRA+ALVO+DE+SUSPEITAS+DE+PLAGIO) an existing allegation of plagiarism of the new logo for the Rio 2016 Olympic games. Accordingly, the logo was compared with the Telluride Foundation symbol, which is a philanthropic organization located in the American state of Colorado, and evidences that they are graphically and conceptually alike.

Clarifying this IP controversy is an urgent matter, as the exploitation of the Rio 2016 symbol and commercialization of goods with the symbol will be in the market very soon and will, undoubtedly, be exploited, not only by the authorized licensees, but by pirates as well. Action against counterfeiting will need to be initiated urgently.

How to sell gemstones? GI marketing!

The Brazilian Instituto Nacional da Propriedade Industrial (INPI) has received yet another application of Geographical Indication (GI) for a stone. However, this time is not just a stone but a gemstone named ‘opal’.

The opal of Pedro II, the city located 195 km north of Teresina, Piauí, is a gem undervalued in the country but, according to the news, easily found at stores like Cartier and Tifany, among other famous jewelers. Obtaining a GI is part of a process that began with a Local Productive Arrangement (APL) developed by Sebrae / PI, in partnership with the Center for Mineral Technology of RJ (CETEM), the Government of Piaui, the Municipality of Pedro II, among others.

The reports explains that “with the merger of the Cooperative Association of Prospectors and Lapidary Jewelers and Pedro II and the training and technology for the extraction and production of jewelry, the opal is already responsible for a considerable increase in income generation and promotion of tourism in the region.”

Marketed at $ 120 a carat, the gem represents an enormous wealth for the city of Pedro II. It is believed that the extraction of opal has not reached even 5% of the total that can be found in that region. The multicoloured opal, one of the most valued, is found only in Pedro II, Piaui, and Australia.

Brazil: extending patent protection, a generous affair to whom?

The Brazilian Superior Court of Justice (STJ) decided last Thursday, December 16, 2010, to deny patent extension to the drug Plavix, used to treat arterial thrombosis.

The current Industrial Property Law, published in 1996, included the pipeline system that protects inventions of pharmaceutical and chemical patents that could not be registered before. Through this mechanism, the patent would have a year to be made to the INPI and worth the time remaining in the country where it was first applied.

The patent application for Plavix was first made in France in 1987. As the patent is valid for 20 years, the Brazilian Instituto Nacional da Propriedade Industrial (INPI) granted protection until 2007. Nevertheless, the laboratory has obtained an extension in France until 2013 and sought to gain equal rights in Brazil. However, the Supreme Court upheld the 37th Federal Circuit decision and denied such extension.

The TSJ explained that patent extension would hurt the Brazilian law, because the maximum term is 20 years. Moreover, it was considered that the extension would contravene the public interest.

Venezuela – Aprueba proyecto de Ley para controlar Internet.

La Asamblea Nacional aprobó el Proyecto de Ley de Reforma de la Ley de Responsabilidad Social en Radio, Televisión y Medios Electrónicos. Dicha ley da facultades al gobierno para controlar los contenidos que se publican en Internet.

Al igual que ya lo hacía con la radio y la televisión, la ley prohíbe la publicación de contenidos “ofensivos”, “violentos” y que “fomenten zozobra en la ciudadanía”, “alteren el orden público”, “desconozcan a las autoridades” o “induzcan al homicidio”, y responsabiliza a los sitios web del contenido de los mensajes en ellos, algo que la oposición ya ha calificado de censura.

A partir de esta reforma a la Ley de Responsabilidad Social en Radio, Televisión y Medios Electrónicos, éstos deberán asumir la responsabilidad por la información de mensajes que inciten al odio, la intolerancia política y religiosa, la apología al delito, impliquen propaganda de guerra, alteren el orden público, desconozcan las autoridades legítimamente constituidas, induzcan al homicidio, entre otros tipificados como contenidos prohibidos.

Para evitar este tipo de publicaciones, la ley establece que "los proveedores de medios electrónicos deberán establecer mecanismos que permitan restringir, sin dilaciones, la difusión de mensajes divulgados que se subsuman en las prohibiciones contenidas en el presente artículo (27), cuando ello sea solicitado por la Comisión Nacional de Telecomunicaciones en ejercicio de sus competencias".

Variedades Vegetales en Chile

La ley 19.342 de 1994, que regula en Chile los derechos de obtentores de nuevas variedades vegetales bajo las condiciones del UPOV 78, está en vías de ser reformada. El proyecto de ley que "Regula el Derecho sobre Obtenciones Vegetales y deroga la ley 19.342" tiene su origen  en el año 2008 cuando el Ministerio de Agricultura terminó de redactar un proyecto que se presentó al Congreso el 14 de enero de 2009, el que actualmente se encuentra ad portas de iniciar  su segundo trámite legislativo (en el comienzo de 2011) , tras pasar por un complejo proceso en la Cámara de Diputados.

Como ha sido la tónica, con motivo de los compromisos adquiridos tras la firma del Tratado de Libre Comercio con Estados Unidos (2003), Chile se obligó a adecuar su legislación en materia de propiedad intelectual vegetal para cumplir con dicho acuerdo comercial, debiendo haber adherido al UPOV 91 antes del 1 de enero de 2009, lo que implica un atraso en su compromiso internacional, hoy en vías de ser cumplido.

La normativa vigente de obtentores vegetales otorga un derecho de propiedad intelectual a quien crea una nueva variedad vegetal (agrícola o frutícola), la que debe cumplir con cinco requisitos para ser registrada como propia: ser nueva, distinta, homogénea, estable y con denominación varietal. La entidad encargada del Registro de Variedades Vegetales es la División Semillas del Servicio Agrícola y Ganadero (SAG), que hoy cuenta con 670 variedades protegidas, de las cuales 594 son extranjeras y 76 son chilenas.

Las modificaciones a la actual ley se adaptan a los reglamentos de la Unión Internacional para la Protección de las Obtenciones Vegetales (UPOV) e incluyen, entre otros aspectos, el aumento de la extensión de la propiedad intelectual de nuevas variedades de 18 a 25 años en el caso de los árboles y vides, y de 15 a 20 años para otras especies. Además, establece el alcance de la propiedad sobre el producto de la cosecha y acota el privilegio del agricultor a un número de hectáreas definido. La actual legislación protege únicamente el material de reproducción, (las semillas), en cambio, el UPOV 91 trasciende al producto de esa semilla y se extiende al grano cosechado.

Más allá del cumplimiento formal del Tratado de Libre Comercio con Estados Unidos, la modificación legal apunta también a mejorar la competitividad del sector agroindustrial y prevenir las infracciones a los derechos intelectuales. 

En cuanto al incremento de la competitividad del sector agroalimentario, tendría lugar mediante la creación y comercialización de nuevas variedades vegetales, de mejor calidad para el mercado doméstico e internacional, permitiendo un mejor acceso al material genético de primera categoría que se produce a nivel mundial, para ampliar nuevas líneas de investigación a variedades agrícolas y frutícolas. Igualmente, aseguraría a los inversionistas extranjeros una adecuada protección de sus nuevos desarrollos, permitiendo, especialmente a los productores frutícolas chilenos, acceder para su producción a variedades frutales que están siendo demandadas en los mercados de exportación . En la actualidad la creación de nuevas variedades puede realizarse mediante técnicas de selección y cruce de especies, mutagénesis o técnicas convencionales de fitomejoramiento (en donde se cambia el genoma completo de la especie) y transgénesis (donde se modifican uno o dos genes).

En su dimensión preventiva de infracciones, la nueva norma apunta a reforzar el derecho de propiedad intelectual de nuevas variedades, evitando la venta y comercialización de semillas piratas, vale decir, de aquellas que hayan sido reproducidas a partir de una variedad registrada previamente. En la práctica muchos agricultores extranjeros son reacios a enviar sus variedades a Chile pues son copiadas ilegítimamente, lo que merma la credibilidad y competitividad del sector. Dentro de las acciones más representativas de infracción, algunas tipificadas como delito en el Derecho chileno (en especial el artículo 44 de la ley vigente) está el exportar la fruta de una variedad sin haber obtenido autorización del titular, cambiar el nombre de una variedad protegida por el de una variedad libre (aquellas que siempre han existido o que son creadas y que han perdido la novedad), y cambiar el nombre de una variedad protegida por el de una variedad de fantasía.

Chile: Mineros S.A.

Los ya conocidos 33 mineros rescatados desde la mina San José, (32 chilenos y un boliviano) pactaron la creación de una sociedad anónima para "proteger, licenciar y explotar sus derechos intelectuales y de imagen" en películas, libros y otros productos generados a partir de su historia, según informaron en la prensa chilena.
 
Mediante una declaración relataron que "con este paso, los mineros nos damos una organización legal y obtenemos una asesoría de primer nivel, que nos permitirá colocar nuestros derechos en el mercado mundial, con miras a la realización de películas, libros y demás productos"

Motivados por su abogado encargado de sus asuntos penales, los 33 mineros contrataron a un estudio de abogados con departamento de propiedad intelectual, y designaron a sus compañeros  Raúl Bustos y Juan Illanes como representantes en las gestiones de comercialización.

La estructura  jurídica se basa en una sociedad anónima de la cual los 33  mineros serán accionistas en partes iguales, la que será la titular del 80 por ciento de los ingresos que se generen a partir de los derechos intelectuales que puedan gestionarse. De forma paralela una sociedad agente representará a los mineros en las negociaciones, y percibirá el 20 por ciento restante de los ingresos, la cual tendrá participación de inversionistas.

Según la declaración de los mineros, el acuerdo "permite formalizar el pacto de silencio" que se ha mantenido desde el rescate", y a la vez, contempla la posibilidad de que cada minero pueda comercializar sus derechos individuales charlas, entrevistas o cualquier otro producto.

"El primer objetivo de esto es decir: los mineros están organizados. El segundo, comunicar que estos derechos tienen dueños. El tercero, aclarar que no se ha autorizado a nadie para usarlos", dijo uno de los abogados que los asesora en esta operación.

Being in Peru from the next weeks makes me feel closer to news concerning IP in Latin America. Maybe that's the reason why Gustavo M. Rodriguez Garcia (Benites, Forno, Ugaz & Ludowieg, Andrade) has informed be of the granting by INDECOPI of the sixth denomination of origin of Peru to Loche de Lambayeque, an agricultural product grew in an anchestral manner that is fundamental for the gastronomy of Nothern Peru.

Can we feed the hungry on statistics?

This week the Brazilian Instituto Nacional da Propriedade Industrial (INPI) has released statistical information. According to the information, due to the restructuring in progress, INPI has managed to reduce the average time for granting patents.

In 2009, the average was 9.3 years and it is now 8.3 years; the goal is set for 2014 - 4 years. The information also released the increase productivity of INPI. The number of examinations increased from about 8,000 in 2005 to over 19,000 in 2009. Granting patents have also raised from approximately 1,800 in 2006 to more than 3,100 in 2009.

INPI explains that the reduction in time and productivity is based on three factors:
1.- Hiring of staff: INPI conducts periodic competition to select qualified researchers, with at least Masters Degree in relevant technical area. In 2005, the number of examiners was 112 and reached 273 in 2010.
2.- Computerization: this month INPI started to use Eptos system that allows electronic processing of all applications. The system is already in testing phase (internally) and should full start in 2012.
3.- Review of procedures: preliminary examination for applications filed in Brazil along the lines of the PCT.
