TV and Radio signal in Hotel rooms under Brazilian Copyright

Hotels that have radios, televisions or similar devices installed in their rooms should pay royalties to the Central Bureau of Collection and Distribution (ECAD).

A hotel in Porto Alegre brought an action for declaration of non-existence of debt against ECAD after refusing to pay bills issued by the entity. The 6th Civil Court of Porto Alegre denied the request, considering that according to Article 29 of Law No 9610/1998, installing alarm clock radio and television in hotel rooms are subject to the payment of royalties.

The hotel appealed and the Court of Rio Grande do Sul (TJRS) found that because the transmission did not occur in areas of the hotel but the rooms, ECAD could not claim any payment. The Court held that the establishment would not even know which stations or songs were tuned.

On appeal to the Superior Tribunal de Justica (STJ), ECAD argued that the hotel rooms were often places of public nature and that payment for the copyright would not be jeopardized by the fact that the broadcasting devices remain available to the client so that they can turn it on or off. It was also noted that the existence of radio and TV helps hotels to attract customers and improve the classification of the establishment (obtaining stars). In turn, the hotel claimed that the hotel rooms are not considered as sites of ‘public’ nature but for the exclusive use of guests – ‘private’ nature.

In its vote, the minister Sydney Benet, rapporteur of the case, said that Law No 9610/98 changed the understanding of charges made by ECAD. Before, the law oversees the rule that "the use of radio receivers inside hotel rooms did not involve public performance of works, but privately run," which made improper payments to ECAD (Law 5988/1973).

From the new law, the STJ addressed that hotels are often regarded as places of the ‘public’. Therefore, the executions of works featured in such places are regarded as public performance.

The minister also noted that although Article 23 of Law No 11.771/2008 considers the rooms as individual units of frequency, the analysis of this case is limited to the legislation prior to this law. With this reasoning, the court held the hotel to pay ECAD.

Brazil’s role and intention during pandemics

During a meeting of the World Health Assembly, being held in Geneva since last Friday 20, the member countries of the World Health Organization (WHO) reached an agreement on the sharing of viruses and benefits (drugs, diagnostic kits and vaccines, among other inputs) resulting from an influenza pandemic. From this decision, the industry will accelerate the process of transferring technology for production of vaccines (countries will be able to have faster access products to protect their populations because it will be possible to have access to data on the virus, in addition to medicines, vaccines and supplies for diagnosis) and will donate 10% of production to the WHO Strategic Fund.

WHO’s Director-General publicly thanked Brazil for assistance in the process of discussion and approval of the agreement. It all started when in 2006 Indonesia recorded cases of bird flu and needed to send virus samples to a WHO collaborating centre in Australia. At the time, Indonesia has submitted a formal complaint to the WHO, arguing that without standards that regulate the sector, the countries with outbreaks of influenza could not take advantage of important information about the virus quickly enough to make decisions.

In 2009 during a pandemic of influenza A H1N1 and at the World Health Assembly, Brazil led a group of countries who argued that technological innovations for the new influenza should be public. With support from the delegations of two continents (Asia and Africa), as well as Latin American countries, Brazil has managed to approve a resolution which has put the issue of sharing information about influenza A H1N1 and any new flu on the agenda of global debates.

The Brazilian Secretary of Health Surveillance, who was in the Assembly, explained: " in a moment of crisis there is not time for profit, it is time for solidarity to ensure the protection of persons and, consequently, the health of countries". Also, during the Assembly, the Brazilian Minister of Health announced Brazil’s intention of being the first Latin American country to join the network of WHO collaborating centres for influenza.

Finally, the report stressed that the agreement adopted at the WHO applies only in pandemic situations, having no validity to seasonal virus.

Chile ramps up WIPO commitments.

There's so much happening in Chile at the moment -- and the country is also gearing up its commitment to international treaties. WIPO has just confirmed Chile's accession to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure (see Budapest Notification No. 274) and the Trademark Law Treaty (see TLT Notification No. 54).

Both treaties are effective in Chile from 5 August 2011.

Brazil: modernization of the Copyright Act

The Minister of Culture is holding a seminar in Brasilia to finalize the preparation of the Draft Law. To this regards, the Ministry of Culture is accepting applications for interested parties to participate in the seminar ‘The Modernization of the Copyright Act: Final contributions to APL.’ The event will be held on May 31st and June 1st in the auditorium of the Superior Court of Justice in Brasilia, which is aimed to finalize the collaborative process of elaboration and improvement of the Draft Law (APL), which amends and adds provisions to Law No.9.610/98 (LDA).

Interested parties have until May 30 to submit their contributions. The period of suggestions - which aims to refine the text - starts the final stage of drafting the final proposal to be submitted to Congress by the government. According to the work schedule of the Ministry of Culture, the bill will be forwarded to the ‘Casa Civil’ which will direct the bill to Congress.

Se resolvió litigio de marcas Kiowa / Cohiba

Conforme informamos en un anterior post, el 18 de enero de 2011 tuvo lugar la vista del recurso de anulación presentado el 9 de junio de 2008 por Corporación Habanos S.A. contra la OAMI de la Unión Europea y la compañía española Tabacos de Centroamérica, en el litigio marcario por el registro de la marca Kiowa.

Hoy el asunto fue resuelto por el Tribunal de Justicia de la Unión Europea, que decidió rechazar el recurso interpuesto por la Corporación cubana Habanos para la anulación del reconocimiento en el mercado europeo de la marca de tabaco "Kiowa", al considerar que no existe riesgo de confusión con el signo distintivo "Cohiba", por lo que ambos serán coexistentes.

Chile: Senado aprueba UPOV 91

Por 13 votos a favor, 5 en contra y 6 abstenciones, la Sala del Senado aprobó en general y en particular el proyecto de acuerdo, en segundo trámite, relativo al "Convenio Internacional para la Protección de las Obtenciones Vegetales" de 2 de diciembre de 1961, revisado en Ginebra según el Acta de 19 de marzo de 1991, conocido como UPOV 91. La iniciativa, quedó en condiciones de ser remitida al Presidente de la República para su promulgación. Este proyecto había sido aprobado previamente en particular por las Comisiones de Agricultura y de Relaciones Exteriores.

La Unión Internacional para la Protección de las Obtenciones Vegetales, UPOV, es una organización de carácter intergubernamental, de la que Chile es parte desde 1996. Dicha Unión, fue establecida en el año 1961 por el Convenio Internacional para la Protección de las Obtenciones Vegetales (Convenio UPOV) que es un acuerdo internacional que data de 1961. E Convenio ha sido modificado en tres oportunidades: 10 de noviembre de 1972, 23 de octubre de 1978 y 19 de marzo de 1991. A la fecha, 43 de los 67 miembros de UPOV han adherido al Acta de 1991, encontrándose entre sus miembros países tan diversos como Australia, Albania, China, Corea, Finlandia, Italia, Jordania, Marruecos, Turquía, Singapur y Vietnam.

En la discusión en Sala varios Senadores hicieron uso de la palabra: El Presidente de la Comisión de Agricultura, senador José García Ruminot, se manifestó a favor de aprobar el proyecto y reiteró que este convenio sólo pertenece a una serie de instrumentos a nivel internacional que apuntan a proteger los derechos de autor y no afectará a los productores nacionales. Asimismo, expresó su preocupación porque si Chile no se adhiere a este convenio, podrá ser en el futuro sancionado por instancias internacionales, ya que los Tratados de Libre Comercio con Estados Unidos, Japón y la Unión Europea, así lo obliga.

En tanto, el senador Carlos Larraín explicó que "hay que honrar el Convenio Internacional que fue extendido en el año 91 y Chile está en la obligación de aprobarlo". Insistió que "con la ratificación de proyecto no se verán afectados nuestros agricultores nacionales y no desaparecerán las especies nativas". A favor se manifestó el senador Eugenio Tuma y dijo que "pueden haber dudas respecto de este Convenio, pero el problema que tiene hoy el pequeño agricultor es que debe competir en el mercado. Conozco algunos que lograron salir de la pobreza, cuando construyeron invernaderos y han pagado semillas de mejor calidad".

A su turno, el senador Carlos Kuschel, quien también dijo estar a favor el proyecto, indicó que "sino lo hacemos, la realidad avanza, durante este tiempo ya se han registrado más de 700 variedades de semillas. Este convenio, nos permite acreditar laboratorios en Chile, además nuestra agricultura requiere de semillas de última generación para ser una potencia agro en el mundo".

Una opinión contraria al proyecto de acuerdo manifestó la senadora Ximena Rincón, quien dijo que "existe miedo sobre los costos que podría afectar a la agricultura chilena". Explicó que no tiene sentido aprobar este convenio internacional, si aún no se cuenta con la ley sobre obtentores de vegetales. El senador Alejandro Navarro, también se mostró contrario a la aprobación de este proyecto y criticó los Tratados de Libre Comercio que suscribió Chile con Estados Unidos, Japón y la Unión Europea y que obligan ratificar este convenio. Agregó que países claves en agricultura en América del Sur como Brasil y Argentina se han adherido sólo a UPOV '78 y no al '91. Asimismo, criticó que las implicancias de este convenio no hayan sido difundidas a la comunidad, tal como lo fue el TLC con Estados Unidos y la Unión Europea. En esa misma línea, el senador Jaime Quintana, se mostró en contra de ratificar este proyecto y explicó que le genera serias dudas, porque "afectará a los productores agrícolas nacionales". A su juicio, "para que tenga valor este convenio, Chile debe contar con la ley de obtentores de vegetales que todavía no lo votamos; si aprobamos este proyecto de acuerdo va a ser letra muerta". Estos tres Senadores anunciaron que recurrirán ante el Tribunal Constitucional.

Finalmente, el senador Hernán Larraín explicó los alcances de la aprobación del convenio Upov 91 con el fin de dilucidar dudas respecto de la reutilización de las semillas y del uso de éstas en procesos de transgenia, señalando que "hay demasiada desinformación" en estas materias pues "se trata de proteger a los creadores de distintos tipos de semillas, entre las cuales está también, Chile. Por ejemplo, en materias de trigo o incluso de arroz, el grueso de las semillas que se producen son de producción nacional y lo que estamos evitando es que otros comercialicen y utilicen lo que es creación de chilenos".

"Por lo tanto, aquí hay protección no solamente a extranjeros, sino también a chilenos" dijo el legislador y recalcó que "lo que se está prohibiendo no es la reutilización de la semilla: si alguien compra una semilla y ésta es reutilizada después por el mismo productor al año siguiente, no tiene ningún problema, la prohibición apunta a una comercialización de algo que adquirió producto del trabajo de otro".

Asimismo, el parlamentario  afirmó que "las fuentes vegetales originarias, como las papas por ejemplo, no son patentables y, por lo tanto, respecto de ésta no va a haber nunca dificultades".

Mexico: forged alcohol beverages receive more than a hangover

The Federal Criminal Process Judge of the Second District Court in charge of the criminal case 185/2008-II, sentenced two individuals for committing the crime of forgery of trade marks with three years imprisonment. According to the Mexican Industrial Property Act (reformed and published in 1999) and in accordance with the provisions of Article 223 Sections II and III counterfeits are crimes.

Combating Counterfeiting of Trade marks in Mexico, has gotten the first conviction obtained for the alcoholic beverage industry in the field of trade mark counterfeiting. BROWN-FORMAN CORPORATION, owner of several trade marks of alcoholic beverages obtained what several sources are calling an ‘historic conviction’ for the alcohol beverage industry in the field of trade mark counterfeiting. The delinquents were forging the marks ‘Herradura’ and ‘El Jimador’ both for tequila and owned by Brown Forman Corp.

INPI postpones request for GI

The Brazilian Instituto Nacional da Propriedade Industriale (INPI) has decided to grant Geographical Indication for a variation of the coffee produced in the Region of Mantiqueira, however, it informed that there is still some administration procedure that needs to be fulfilled. This information was published on May 10, 2011 in the Journal of Industrial Property (RPI), which indicates that from this date onwards the Association of Coffee Producing Mantiqueira has 60 days to prove, at the INPI, the payment of the fee. Fulfilled this, INPI will award the registration certificate.

This will be the ninth GI granted to national products in Brazil. There are three more pending: Manguezais de Alagoas for propolis; Jalapão for golden grass; and Vale dos Vinhedos for wines. The later already hold a GI but just a certification of ‘Indications of Source’, the pending application was for a ‘Denomination of Origin’.

Basically, the Geographical Indication is a certification that guarantees the suitability of the product and its quality. According to INPI, GI becomes a competitive advantage to its holders and gives as an example the case of ‘Valley of the Vineyards’, which owns a GI since 2002, and had a big boost in tourism (which grew over 300% during this period) and local production (the number of wineries has grown from 15 to 31).

Chile: Cursos e-learning sobre Propiedad Industrial (INAPI)

El Instituto Nacional de Propiedad Industrial de Chile (INAPI) ha puesto a disposición del público los primeros cursos e-learning en materias de Propiedad Industrial. Los interesados podrán acceder al sitio web AULA INAPI, dónde podrán preinscribirse en cualquiera de los tres cursos gratuitos actualmente disponibles: Introducción a las Patentes, Introducción a las Marcas Comerciales y Servicios y Herramientas en Línea del INAPI. El único requisito para realizar un curso es preinscribirse dentro de los plazos establecidos. Los cupos de los cursos son limitados, por lo que una vez que éstos se completen se cerrará el proceso de registro. Tras realizar satisfactoriamente el programa de estudios, el Instituto Nacional de Propiedad Industrial enviará a cada alumno un certificado de participación y aprobación del curso.

El AULA INAPI es uno de los tres componentes del proyecto "Plataforma de difusión de la Propiedad Industrial y Transferencia de Conocimiento", que actualmente está desarrollando el INAPI en conjunto con la Unión Europea y que tiene como objetivo contribuir a la implementación, impacto y alcance de la política de Propiedad Industrial a través de herramientas innovadoras que permitan potenciar los servicios de información y difusión de la Propiedad Industrial, así como el acercamiento y vinculación con los actores y usuarios del sistema nacional de innovación.

En este sentido, el proyecto es parte del Programa de Innovación y Competitividad UE-Chile, iniciativa de cooperación ejecutada por diversas instituciones públicas para promover la innovación y el emprendimiento en beneficio del desarrollo económico del país. En su primera fase, cuenta con un financiamiento de 18,6 millones de euros, aportados en partes iguales por la Unión Europea y el Gobierno de Chile, bajo la coordinación de la Agencia de Cooperación Internacional de Chile (AGCI).

Argentina: Taringa sancionada por violar Derechos de Autor

Quien no ha escuchado hablar del sitio web Taringa? Otro de las diversas opciones que hay para acceder a descargas directas de todo tipo de archivos, como música, películas, series, etc-

Pues bien, dicha web es noticia por que la Sala VI de la Cámara Nacional de Apelaciones en lo Criminal y Correccional confirmó el procesamiento de los propietarios de Taringa por considerarlos “partícipes necesarios” del delito de violación a la propiedad intelectual al permitir que, a través de su sitio, diferentes usuarios suban y descarguen material protegido por esa ley.

En su descargo, los imputados alegaron que “es imposible que determinen el contenido de las cargas y establezcan si violan los derechos de autor cuando diariamente, en promedio, se realizan veinte mil ‘post’ y porque no tienen acceso al Registro Nacional de la Propiedad Intelectual para cotejarlo”.

Sin embargo, los jueces sostuvieron que “los imputados a través de su sitio permitían que se publiciten obras que finalmente eran reproducidas sin consentimiento de sus titulares. Si bien ello ocurría a través de la remisión a otro espacio de Internet, lo cierto es que justamente tal posibilidad la brindaba su servicio”.

Taringa, con más de 5.6000.000 de visitas diarias en mayo del 2010, según datos de uno de sus responsables, es el sitio argentino más visitado.
