El Índice Mundial de Innovación de 2025: Latinoamérica y el Caribe


Hoy se anunció la publicación de la 18.ª edición del Índice Mundial de Innovación (GII, por sus siglas en inglés). Publicado desde 2007, el GII ha sido una fuente útil de análisis para medir la innovación. Consulta aquí mis reportes sobre ediciones anteriores del GII.

El GII de 2025 fue publicado por la Organización Mundial de la Propiedad Intelectual (OMPI), en colaboración con el Instituto Portulans.

El GII de 2025 contiene la más reciente clasificación mundial de innovación de más de 130 economías, basándose en 78 indicadores. El tema del informe de este año es “La innovación en la encrucijada”.

El Explorador de ecosistemas y datos de innovación del GII de 2025 (en inglés) muestra las reseñas sobre el desempeño de cada economía con respecto a todos los indicadores, destacando sus puntos fuertes y áreas de mejora en materia de innovación. Este año se agregó un nuevo filtro que permite revisar el desempeño de la innovación en las siguientes regiones: África, ASEAN, Unión Europea, Latinoamérica y los PMA.

11th Session of the WIPO Conversation on IP & Frontier Technologies: Infrastructure for Rights Holders and Innovation


The World Intellectual Property Organization (WIPO) will hold the Eleventh Session of the WIPO Conversation on Intellectual Property and Frontier Technologies (formerly WIPO Conversation on IP and AI) on 23 and 24 April 2025.

The theme of the eleventh session is “Infrastructure for Rights Holders and Innovation”. The session aims to bring together stakeholders to discuss, inter alia, the challenges that AI poses for copyright, including rights management, attribution and compensation. 

The agenda comprises the following topics:
  • Copyright infrastructure.
  • Infrastructure for training data.
  • Infrastructure for outputs.
  • The EU AI Act and Code of Practice.

10th Session of the WIPO Conversation on IP & Frontier Technologies, AI Output: To Protect, or Not to Protect – that is the IP Question


The World Intellectual Property Organization (WIPO) will hold the Tenth Session of the WIPO Conversation on Intellectual Property and Frontier Technologies (formerly WIPO Conversation on IP and AI) on 5 and 6 November 2024.

The theme of the tenth session is “AI Output: To Protect, or Not to Protect—That is the IP Question.” The session aims to bring together stakeholders to discuss, inter alia, the relationship between AI-generated content and IP, evaluate current practices, and propose practical solutions.

The agenda comprises the following topics:
  • From patentability dilemmas to copyright conundrums: Economic perspective.
  • Current copyright landscape: Where does AI fit in?

El Índice Mundial de Innovación de 2024: Latinoamérica y el Caribe

El GII de 2024 fue publicado por la Organización Mundial de la Propiedad Intelectual (OMPI), en colaboración con el Instituto Portulans.

El GII de 2024 contiene la más reciente clasificación mundial de innovación de más de 130 economías, basándose en 78 indicadores. El tema del informe de este año es “Descubriendo la promesa del emprendimiento social”.

9th Session of the WIPO Conversation on IP & Frontier Technologies: Training the Machines – Bytes, Rights and the Copyright Conundrum


The World Intellectual Property Organization (WIPO) will hold the Ninth Session of the WIPO Conversation on Intellectual Property and Frontier Technologies (formerly WIPO Conversation on IP and AI) on 13 and 14 March 2024.

The theme of the ninth session is “Training the Machines—Bytes, Rights and the Copyright Conundrum”, which aims to bring together stakeholders to discuss the multifaceted relationship between IP and training data. The event will foster a holistic understanding of the impact of training data on the IP landscape by evaluating current practices, proposing practical solutions, and envisioning future direction.

The agenda comprises the following topics:

8th Session of the WIPO Conversation on IP & Frontier Technologies: Generative AI and IP


The World Intellectual Property Organization (WIPO) will hold the Eighth Session of the WIPO Conversation on Intellectual Property and Frontier Technologies (formerly WIPO Conversation on IP and AI) on 20 and 21 September 2023.

The World Intellectual Property Organization (WIPO) will hold the Seventh Session of the WIPO Conversation on Intellectual Property and Frontier Technologies (formerly WIPO Conversation on IP and AI) on 29 and 30 March 2023.

The theme of the seventh session is “IP and the Metaverse”, aiming to bring together stakeholders to discuss the challenges the metaverse may pose to the IP system. El Índice Mundial de Innovación de 2022: Latinoamérica y el Caribe


Hoy se anunció la publicación de la 15ª edición del Índice Mundial de Innovación (GII, por sus siglas en inglés). Publicado desde 2007, el GII ha sido una fuente útil de análisis para medir la innovación. Consulta mis reportes sobre el GII 2021 aquí y el GII 2020 aquí.

El GII de 2022 fue publicado por la Organización Mundial de la Propiedad Intelectual (OMPI), en colaboración con el Instituto Portulans y sus asociados corporativos.

El GII de 2022 contiene la más reciente clasificación mundial de innovación de 132 economías, basándose en 81 indicadores. El tema del informe de este año es “¿Cuál es el futuro del crecimiento impulsado por la innovación?”.

El GII de 2022 también destaca los efectos positivos de dos nuevas oleadas de innovación:
  1. Oleada derivada de la era digital, basada en la supercomputación, la inteligencia artificial y la automatización. Efecto: tener una amplia incidencia en la productividad de todos los sectores y en todos los ámbitos de investigación científica.
  2. Oleada de innovación en ciencia profunda, basada en avances en la biotecnología, la nanotecnología, el desarrollo de nuevos materiales y otras ciencias. Efecto: cambiar por completo las innovaciones en la salud, la alimentación, el medio ambiente y la movilidad (cuatro campos de importancia clave para la sociedad).

6th Session of the WIPO Conversation on IP & Frontier Technologies: AI Inventions


The World Intellectual Property Organization (WIPO) will hold the Sixth Session of the WIPO Conversation on Intellectual Property and Frontier Technologies (formerly WIPO Conversation on IP and AI) from 21 to 22 September 2022.

The theme of the sixth session is “AI Inventions”, aiming to share information and build awareness around patent examination practices, tools, and guidelines for AI inventions. As such, it will be addressed:

  • What are the market trends, and how do these translate in terms of patent applications?
  • How autonomous is AI?
  • What role does it play as part of the inventive process or as an invention?
  • What questions does this raise for the IP system? 
  • How are IP Offices supporting AI inventors?

Asamblea General de la OMPI avanza hacia la celebración de conferencias diplomáticas sobre diseños y conocimientos tradicionales asociados a recursos genéticos


El 21 de julio de 2022, los Estados miembros de la Organización Mundial de la Propiedad Intelectual (OMPI) aprobaron la convocación de conferencias diplomáticas sobre diseños y recursos genéticos, a más tardar en 2024.

Las conferencias diplomáticas son rondas de negociación en las que se adoptan o revisan tratados multilaterales.

La decisión de avanzar hacia conferencias diplomáticas se tomó durante las Asambleas de los Estados miembros de la OMPI, que se llevaron a cabo del 14 al 22 de julio de 2022, en relación con los siguientes instrumentos.


Propuesta de Tratado sobre el Derecho de los Diseños (DLT)

El Tratado tiene como objetivo agilizar el sistema internacional de protección de los diseños, haciéndolo más fácil, rápido y económico al acelerar los procedimientos y eliminar la burocracia.

En 2006, se iniciaron los trabajos de simplificación de los procedimientos para la protección de los diseños industriales en el Comité Permanente sobre el Derecho de Marcas, Diseños Industriales e Indicaciones Geográficas (SCT), evolucionado hasta convertirse en el borrador del DLT propuesto.



Proyecto de instrumento jurídico internacional relativo a la propiedad intelectual, los recursos genéticos y los conocimientos tradicionales asociados a los recursos genéticos

Este instrumento jurídico abordará aspectos de la propiedad intelectual sobre el acceso, la utilización y distribución de los beneficios de los recursos genéticos (p. ej., plantas, animales y microorganismos) y los sistemas de conocimiento.

La OMPI brindó ejemplos de tales aspectos de la PI, como “una de las ideas que cuentan con el apoyo de numerosos países es que los solicitantes de patentes cuyas invenciones utilicen recursos genéticos y CC.TT. conexos deberían divulgar ese hecho y demás información conexa en las solicitudes. Este punto constituye una propuesta de ‘requisito de divulgación en las solicitudes de patente’. Otras ideas [... incluyen] un mayor uso de las bases de datos de información sobre recursos genéticos y CC.TT., lo que permitiría evitar que los examinadores de patentes concedan patentes erróneas.”

El instrumento jurídico tiene como objetivo, entre otros, armonizar los sistemas nacionales, fomentar el desarrollo de las comunidades indígenas y locales, y mejorar la calidad, eficacia y transparencia del sistema de patentes.

La OMPI enfatizó que desde 2010, “en el Comité Intergubernamental sobre Propiedad Intelectual y Recursos Genéticos, Conocimientos Tradicionales y Folclore (CIG) se están llevando a cabo negociaciones sobre un instrumento jurídico internacional relativo a la propiedad intelectual, los recursos genéticos y los conocimientos tradicionales (CC.TT.) conexos, así como sobre la protección de los CC.TT. como tales y las expresiones culturales tradicionales o el folclore.”

Tequila: finaliza la investigación bajo el Reglamento sobre obstáculos al comercio (TBR) de la UE


El 3 de febrero de 2022, la Comisión Europea anunció que finalizó formalmente su investigación sobre la denuncia referente a obstáculos al comercio en el sentido del Reglamento (UE) 2015/1843 (Reglamento sobre obstáculos al comercio, TBR en inglés) aplicados por México y consistentes en medidas que afectan la importación del Tequila. La denuncia

La denuncia había sido presentada por la Asociación de Cerveceros de Europa (The Brewers of Europe) debido a la decisión del Consejo Regulador del Tequila (CRT) de “ya no [conceder] certificados de exportación a … [TdS, una empresa] que produce y exporta «Tequila» …  [a una] filial de Heineken NV … [debido a que] la cerveza Desperados de Heineken (una cerveza con aroma de «Tequila» añadido) infringe la [Norma Oficial Mexicana] aplicable a la utilización de la Indicación Geográfica (IG)” Tequila.

Durante la primera etapa de la investigación de la Comisión, intervinieron 22 partes interesadas, “en su mayoría representantes de asociaciones velando por la protección de las indicaciones geográficas europeas”. En efecto, oriGIn solicitó a la Comisión el reconocimiento como parte interesada considerando las implicaciones de la disputa en cuanto a los principios de las IG.

De igual manera, el procedimiento de examen también fue discutido por el Parlamento Europeo (lea aquí la pregunta parlamentaria planteada a la Comisión Europa, y consulte aquí la respuesta, ambas en inglés).

En mayo de 2021, la Comisión Europea finalizó el procedimiento de examen de la medida aplicada por México que afecta las exportaciones del Tequila a la UE (consulta el reporte aquí). Se concluyó “que si bien la medida plantea preocupaciones sobre el cumplimiento de México respecto de las normas de la OMC, específicamente la prohibición de restricciones a la exportación, está sujeta a una serie de procedimientos administrativos pendientes que pueden conducir a la revocación o modificación de la medida. Por lo tanto, la Comisión continuará monitoreando el resultado de los distintos procedimientos y, dependiendo de su resultado, podrá reevaluar las acciones a emprender” (énfasis añadido).

En octubre de 2021, la Asociación de Cerveceros de Europa informó a la Comisión Europea que “la empresa de la UE afectada había encontrado una solución con las autoridades mexicanas, lo que permitió la eliminación de los supuestos obstáculos al comercio”. En consecuencia, retiraron la denuncia.

*El 7 de febrero de 2022, se publicó en el Diario Oficial de la Unión Europea, la Decisión de Ejecución (UE) 2022/161 de la Comisión de 3 de febrero de 2022 por la que se da por concluido el procedimiento de examen relativo a los obstáculos al comercio, en el sentido del Reglamento (UE) 2015/1843, aplicados por los Estados Unidos Mexicanos y consistentes en medidas que afectan a la importación de Tequila. El retiro de la denuncia y la finalización de la investigación por parte de la Comisión Europea suceden al acuerdo amistoso entre CRT y Heineken, luego de que CRT iniciara varias acciones legales en la Unión Europea que involucraban el uso de la palabra Tequila en la cerveza Desperados. CRT y Heineken ponen fin amistosamente a la disputa por el uso de la palabra “Tequila” en la cerveza Desperados


CRT (el Consejo Regulador del Tequila) anunció que la disputa legal por el uso de la palabra Tequila en la cerveza Desperados ha terminado.

En un video difundido el 13 de julio de 2021, Miguel Ángel Domínguez Morales (presidente del Consejo Regulador del Tequila) indicó que se ha llegado a un acuerdo amistoso con Heineken luego de que CRT iniciara varias acciones legales en la Unión Europea que involucraban el uso de la palabra Tequila en la cerveza Desperados.

Aunque los términos permanecen confidenciales, Miguel destacó que el acuerdo es beneficioso para ambas partes y que el Tequila continúa fuertemente protegido en la Unión Europea [su segundo mercado de exportación más grande después de Estados Unidos].

De acuerdo al comunicado de prensa, anualmente se exportan alrededor de 20 millones de litros a la Unión Europea, donde se encuentran disponibles más de 50 marcas de tequila*.

Registration is now open for the 4th Session of the WIPO Conversation on IP and Frontier Technologies!


As announced here, the World Intellectual Property Organization (WIPO) will hold the Fourth Session of the WIPO Conversation on Intellectual Property and Frontier Technologies (formerly WIPO Conversation on IP and AI) from 22 to 23 September 2021.

The theme of the fourth session is “Data – beyond AI in a fully interconnected world”. Registration is now open here!

The agenda and the information about the format (e.g., only virtual meeting) will be provided afterwards. However, it has been already confirmed that the session will be available online, including a “video on demand recording [that] will also be published in due course”.

Likewise, you can respond to the Frontier Technologies and Data Questionnaire to share insights into “the challenges and opportunities you see, your stories and your views”. The responses will help to shape the fourth session.

Mercado Libre published its first Transparency Report


On 19 May 2021, Mercado Libre (MELI) published its first Transparency Report. MELI stated that the report’s purpose is “to make our policies and actions transparent to safeguard the security and privacy of over 74 million users in our entire regional ecosystem”.

The Transparency Report consists of three main sections: product security and quality, protection of IP rights, and privacy matters. Read below some highlights of the report!


Section: Product security and quality

This section contains stats about removed content due to violations of MELI’s Terms and Conditions (T&C), which inter alia, prohibit certain items are sold on the platform (e.g., medicines, counterfeit items and other goods violating IP rights):

  • 331,607,978 listings were placed on the 18 MELI's websites as of 31 December 2020.
  • 18,570,436 listings were detected and moderated by MELI due to violation of its Listing and Prohibited Items Policies.
  • 112,424 listings were reported by users.
  • 65,180 listings were removed due to COVID-19 related matters.
  • Top 10 product categories regarding removed listings due to violation of MELI’s Listing and Prohibited Items Policies:

  • In the report is highlighted that MELI uses machine learning technologies to detect infringing listings. In this sense, only 3.12% of the detected listings went back to the platform (reactivated ads).

Section: Protection of IP rights

This section contains stats regarding MELI’s Brand Protection Program (BPP), which “enable IPR holders to report infringing listings [via a Notice & Take Down -N&TD- procedure] in any of the 18 countries where Mercado Libre operates”.

  • 2,107,264 N&TDs were submitted.
  • 104,661 counter-notices were submitted.
